Old Certificate 149 in our Land contract from last year (stage 12) and is huge containing so many lots. For new one, I will have to apply myself. But I am not sure if I need to get certificate 88b or it is in our contract as well? I don't want delays in construction if my builder ask for them at later stage like the GeoTech Report. I think you can also have your 88b instrument from title search using LPI official site, which may cost you around $12... 88B Instrument:The 88B Instrument is a document under Sec 88B of the Conveyancing Act 1919 (NSW). The 88B Instrument sets out the terms of any easements, restrictions or positive covenants in relation to land use. Should your property be affected by an easement, right of carriageway or covenant, council will consider the requirements specified within the 88B Instrument as part of the assessment of your application. To minimise any delays in this regard, it’s important that you’re aware of any restrictions that may affect your lot. We do have easements and they were visible in the contours given by developer and plan given by Landcom initially. My solicitor is too slow to act or never replies. I will check and apply myself. Its a pain to get professionals these days who finish their work. I did not find any glass on the kids playground anymore which is nice. There is still one bin missing from the burned bin holder though. Council will take ages to replace the bin.
