Our estate provides wheat hardifence, but as I'm on the corner, we get Brushwood on the street side. I'm considering upgrading the other two sides of my yard to Brushwood as well, so it matches. How do I contact the neighbours who own those blocks? Two have contacted us but the rear neighbour nothing. In the NSW Act there is an ability to declare the fence and urgent requirement and not consult. In a new development you could by the wording go that route. That particular aspect of the NSW fencing act has a very specific purpose (it relates to stock and security/safety fencing more than anything else) and I'm not sure whether you can apply it to a domestic construction situation. In most cases the following passage of the act still applies: Quote: An owner who goes ahead and builds a new fence without consulting the adjoining owner, before either coming to an agreement or seeking an order, has no grounds under the Act for recovering the cost. In that case the party not building the fence would be required to contribute 50% of the cost set out in a reasonable quote for the minimum spec fence as described in the development guidelines for the estate. How do I go if the side neighbours are fine and the rear is not? 2 Make sure you send the letter inviting your rear neighbour into the discussion via registered mail (ie. they have to sign to take delivery). Also make sure you get the agreements with each neighbour in writing just in case (ie. a letter signed by both parties) - especially for the rear neighbour. Your fencing notice needs to be clear in terms of the type of fence and the positioning of the fence itself, in addition to the quotes you are going to send (make sure they are for the minimum acceptable spec fence as set out in your development guidelines though, as any upgrades will be solely your responsibility to pay for). Also note that you cannot have the fence erected before your neighbour agrees to it (or a local court / land board has handed down an order for the neighbour to contribute). As a general rule of thumb if you need to have the fence done now then you will probably be paying for that section at the rear boundary out of your own pocket, unless you can come to an agreement with the neighbour on that side sooner. Just happy that the side ones contacted me back and are both happy with a Colorbond fence Re: Fence Ettiquite 16Dec 07, 2012 1:51 pm I have had to put my fencing up without consulting neighbours, not my ideal choice but that was pretty much the only choice. we are a cnr block so we only have 2 neighbours to worry about. The land next to us at the time of getting quotes and installing fence was still for sale and owned by the developer. (now aparently sold)the land behind us we did make verbal contact however i lost there contact details incl address (due to packing) and i did not sent the notice to fence. Reason being that we could not wait as we have an outside dog which = fence up straigt away. Am I just going to have to bear the full cost of the rear fence - therefore don't need to contact them? Or does it still count as sharing a fence? If so then you may be able to erect the fence effectively "on top" of the wall - it costs a bit more though as they need to use steel posts fixed to the wall to secure the fence to. I've got fence vouchers from developer, have mailed them in, does anyone know what happens with the vouchers?
