You need legal advice.. Who is your builder?

Start by calling ACCC or fair trading Vic

I think its ARB from an earlier post.

I would definitely get legal advice on this if they are threatening to pull the contract and you lose your deposit.

This sounds a bit extreme. Surely they can adjust the time and/or and give you time to finance this extra money etc...

From what I hear for most contracts, the slab is up to the builder (dependent on soil tests etc) and any slab upgrades that they think are required to build your house safely means you pretty much have to except what they say (but check your contract). The builder is the one that will end up in trouble if the house falls down etc.. so most like to put a slightly stronger slab down than what the soil tests might say is acceptable minimum strength.

My builder included this upgrade cost in my initial quote as an upgrade to an "M" class waffle slab and it cost me about 10k. Weather or not it is required I guess it up the the builder but I guess they will do (have done?) the upgrade anyway as its safer for them in the long run.

All in all, mine was 10k for slab and 5k fixed until May but all this was told to me by my builder and paid for by me upfront so there were no surprises.... and then I had the penalties to pay...

For me, The M class with waffle slab is already include but the problem will start if they do the soil test(after the contract) n required to upgrade...so what will happen becaz we already sign contract with them(M class waffle slab)...trouble will bring up...so stress of building new house..land delay..step by step by the builder..lots more will come...

I'm glad to see stage 10 booming with construction activities, hope that most of homes get completed soon. our estate will hopefully look better than Linley.
I must also share with all my neighbours (vacant blocks) to inspect your site and ensure that your crossings are not damaged. Our front crossing and footpath has been damaged during slab pooring on Lot 1035 Maxfield Road and Lot 1003 Tyres Lane, Simonds has still not got back to us, despite photographic evidence and witnesses. Simonds concrete suppliers "Hanson" Concrete truck drove over our crossing during slab pooring on Lot 1003 Tyres Lane on Wednesday / Thursday 2 weeks ago (around 7th or 8th of September) . I'm sure that owners of lot 1003 will confirm that their slab was poored on that day, not that this is any of the owners fault. If Simonds dont get back to me soon I will have to take legal action against them, this is radiculousthey, they should not be using other peoples properties as a traffic route just because Developer/Council decided to put these stupid traffic islands. It is not our fault that trucks have difficulties manouvering the narrow streets. I WILL MAKE A BIG FUSS OVER THIS.

Any suggestions, Lot 1035 and Lot 1003 owners this is not your fault but I will do my best to make teh responsible builder pay for damages.

lol this is another funny thing my builders have done to me.. gave me back $150 for eaves, my shoes are worth more... first 7500 for delay, then 5600 for slab, and i get $150 back for eaves, hahahha what a joke. A week befor building i get hit with this all...

That’s a joke... I paid $3,300 for 600mm eaves to the entire house.. PD were going to charge $4,800 but they knocked off $1,500.

$150... I would rather have eaves.......... Have a think about what’s involved in constructing eaves (longer roof trusses, extra roof tiles, cement sheet lining and carpenter to do all the wood the installation and trimmings.. two days work).

That’s a joke... I paid $3,300 for 600mm eaves to the entire house.. PD were going to charge $4,800 but they knocked off $1,500.

I'm pretty sure 600mm eaves are an estate requirement unless something has changed in the last few months.

$150 sounds a bit low but I think that would be for something like facade or garage eaves changes.

Seems that if you garage is up against the property boundary you obviously don't need (can't have) eaves on that side (as they would be over on your neighbors side of the property). I have checked this out recently with many of the houses already in Somerfield and this seems to be the norm when your garage is on the boundary. If its not on the boundary then you need eaves to your garage as well (???). Maybe the garage eaves were quoted in the original house design document.

it is a DA requirement for argile houses to have front eves to the house and up to 3 mtrs around the front corners.good luck with you quest with the builder

Mind one is only 450mm so Do we really need to upgrade this eaves? is this really important?

went past stage 14a today, the trees have been chopped and the have started flattening the land and they have started constructing the roads.
Quite surprised too see so at least 5-6 houses come up in the last two weeks when there was not a single...looks like we have been having some terrific weather for so much progress...

the whole area has been filled this is why the slab is p class and piers need to be placed under slab to support it go past stage 14 and look at the amount of fill going in,up to 2mtrs in some areas.

stage 10 has very little fill at corner of Tyres lane and Burnham Crescent, about 500 mm than it gets higher towards the South / West

Does anyone know what is happening with Perry Rd? Are they going to duplicate it all the way down to the bypass? Are they going to put in a foot path? I'm loving living in Somerfield, but the only way to get anywhere is to jump in your car. Its far to dangerous to try and walk to Parkmore (we have tried).

I was thinking the same thing when I was around the area last time. They will be fixing church rd eventually so they may link it all up through perry rd at that stage.

May be worth shooting through an email to somerfield sales to see if they know if / when this would be happening.

Now that my house is going up and with all the work going on in Argyle I was thinking the same thing. Surely they cant leave it like it is now with all the new houses that will be popping up over the next year. I would definitely not be attempting to walk along it in its current state. One person injured walking that gauntlet is one person too many imo.

... i guess its time to start doing what all good rate paying residents do and... "complain to the the council"

So it's been a month of living in Somerfield and i love it so much! such a beautiful place even with all tradework around our street. lots of friendly people and my cat is starting to feel more at home as well

began our front landscaping last week and i think it's gonna be a while till its done as i am doing it myself! can't wait till it's done. how is everyone else going in 1J?

HI all stage 14a people, I think we are getting near...my street name is up so our stage should be ready soon pity we still have to pay fees to our builder as we are penalised for not starting NOV 1st. Hope its worth the wait. Good luck guys!!!
