I am hoping someone might have advice regarding faulty fencing. Last year we purchased a 3 year old property in Aurora (stages 1-7).
We have realized over time that the back fence is faulty. It has become warped and sections are coming off.
I have had an independent inspector come out (sent by BACV) and provide me a report that it is indeed faulty (along with a whole bunch of other items). Hence it looks like I will be taking the builder to VCAT.
In regards to the fencing, the builder is saying that they have nothing to do with it and to take it up with VicUrban.
I have had a look at the Aurora fencing guidelines and its states that if the rear/estate fence is adjoining a street or laneway (which is my situation), then it will be built by the builder and not VicUrban.
So I have a feeling that the builder is trying to brush me off.
Hence if anyone else has fencing alongside a laneway or street, can you advise whether it was the builder who organised the construction of it?

im in stage 14 not sure if things were different back in the early stages i was told vicurban was responsible for fencing as the price was included in the land price which we brought before picking a builder (wasnt house and land package) to be honest we have been in our house for 4 weeks and im not impressed with fence at all we have a gap big enough for hubby to fit under the fence it really needed another plank along the bottom and its not as it my soil is lower then anyone elses we are all the same big gaps under fence. The latch on the side gate broke off and in general it looks cheap splintering everywhere i dont think it will last longer then 5yrs but i cant find anywhere in my paper work from vicurban or builder about any warranty regarding the fence or who the company is.
I have noticed someone in the street is adding onto thier side fence to extend to the front driveway, not sure if i should tell them its not allowed before they finish it and get asked to pull it down.
You a 100% right about the information you have shared here about the fencing. VU is responsible for the fencing and not the builder. There is no fencing allowed on the front or corner of the house as per VU.
