Bugger! Unfortunately its common. We were in Stage 2 and when we bought we were told February 2009 (which is what we arranged with the builder). It then progressively got pushed out further and further until we settled in June 2009. When the extension fee was raised, I went in hard with the builder and threatened to pull out because the 'fee' which was imposed for delay costs was really a penalty and not a genuine pre-estimate of the loss/increase in costs and would have sued them for my deposit and the fee. Its very similar to the class action being run against the banks atm. I got the additional fees waived, but I think at the time the building market was unsure how the GFC was going to work so were happy to waive a few grand to keep me happy. Not sure if anyone would do that now. Tom said that It's going to be in June. I also said that when I bought a land I was told from Amanda and Matt that It's going to be title in February or March. Tom said that according to his paper work the stage 6 always going to be title in May or June 2010. He didn't believe me that Matt and Amanda would tell us about the title is going to take place in Feb or Mar. He also asked me to prove it. I said that It used to be on Matt's blog saying that The Metro Release stage 6 is going to be title in Feb or Mar. So, did anyone from Metro Release speak to Matt or Amanda when you bought a lot and got told that your lot is going to be title in Feb or Mar? And I was told by Ricky from sales that the land will be title by September, therefore I signed the contract building with M and the 150 days policy ends September and I have spoken to M they said to charge me $3000 to cover til end of November. When I bought the land on stage 7 they told me it will be released on July and based on that info I signed my contract with M and now they push it back to Aug/Sept but still with no definite time and M will charges fee for that. Spoke we our conveyancer today and shee confirmed that Stage six should go to titles office next week Planning 4th build and move Glutton for punishment Re: williams landing 920May 24, 2010 11:44 am Please read if you are waiting on Stage 6 Land to settle... I called CW today and spoke to Ashley who advised that the delay is due to the Land Titles Office as CW have lodged Stage 6 Titles. I then called Wyndham City Council and they said in their system it states that CW are waiting on Powercor and MFB. She was unable to advise what the actual hold up was though. She also said that when they get the Titles, it should only take approx 2-4 days on their part. So I then called back CW and told them what the Council said and Ashley was adamant that the delay was with the Land Titles Office. So I called the land titles office and they confirmed they did not have any plans lodged. I called CW back and told Ashley what the Titles Office said and she put me on hold and then apologised and said it was her mistake and that the Titles have NOT been lodged and yes it is a delay with Powercor! She was unable to tell me what the delay was...very frustrating... I am assuming most of you are in a similar situation as per your building Contract states, if sites works are not commenced by a certain time, a fee will be applied.
