Browse Forums Building A New House 1 Apr 29, 2010 9:41 pm We have a situation where our whole street has gone up around us and no one has dumped on our block. However, since the commencement of building next door the dumping has also commenced. For example, the site was scraped, piles of dirt appeared on our block, the slab was laid, a pile of cement appeared on our block, black bags of rubbish resting against the temporary fence on their block are now on our block since the temporary fencing has been removed. We have contacted the builder involved and while there seems to be a general 'we'll get the site supervisor to look into it', we can now not get through to speak to anyone. Of course, I'm furious that this builder won't take responsibility and it's likely we won't be able to compel them to clear their mess. We cannot clear the rubbish ourselves, it's quite a bit of dirt and quite a bit of cement. So my question is, seeing as we're likely to start building in the next 4-6 weeks, should we just take a punt that the builder will clear this at site scrape and send us a bill for their trouble? I had to ring several times before I got the response I wanted direct from the site's supervisor. He was absolutely lovely and genuinely sorry for our inconvenience. I was however, prepared to go into battle to have this moved as our builder had rung us and basically said, 'we're not starting until that's gone.' I know how frustrated you may be. PS I'm not sure exactly which neighbour you think put the rubbish there, but if your block is the one I'm pretty sure I think it is, I was out there the day next to you had their slab poured and saw the concrete truck dump the excess next door. If you're on a deadline and starting to build in only a few weeks, I would ring your neighbour's builder one more time, say you have rung several times, say to them 'you have until next Friday to move that rubbish or I will organise to have it moved and send you the bill.' I'll bet they'll move it then. You could also have them charged for dumping, so they'll move it to avoid these further repercussions. I rang the builder next door as I knew it was from them as my other neighbour had already built. They appologised and said they would speak to the SS. Nothing happened so DH and the neighbour on the other side moved all the reo and dumped it back onto the block next door. We picked up the general rubbish and put it in their rubbish cage. In our case it wasn't too much to do but annoying all the same. As Fel suggested, ring them again and get heavy with them. Why should you have to pay anything??? He is the one doing the calling at the moment, as he is definitely the more calm and reasonable of the two. I think he'll be a bit more firm tomorrow, the receptionist keeps putting him through to someone and it goes to voicemail, so he leaves a message. of course they're not going to call back. I said to Matt that I think you need to request to speak to a person, then and there, and mention that our builder has said that our build simply won't progress if the blocks not cleared. I didn't get anywhere until I rang and said 'I would like to speak to the site supervisor of Lot xxx, my road, Doreen, please.' We couldn't believe the audacity of the concrete dumper, but to be honest, I've seen it 2-3 other times too. We even had a whole heap of concrete dumped on our block from the builder behind us, but you know what? Same builder we used! So they removed it without any complaint whatsoever! We didn't even have to ask. Matt got a call back from the contact at the builder that he has been leaving messages for. Which I must say is a good sign. However, he was met with 'I've spoken to the site supervisor and he says it's not their rubbish'...So thankfully Matt pushed back and said that we were confident it was them and he wasn't satisfied with the response, so the contact is going back to another manager to see what can be done. We were contacted by our builder today to say site scrape will be May 13, so we really need this builder to clear their mess! Will keep this updated with the outcome. We have a house in Doreen. I think they were Best bins hire or something like that and are based in Mernda. Great guy. He came and left within 20 mins as we loaded while he was there. After the SS coming back to us late last week to say he's checked the site again and the stuff on our site 'isn't a result of their dumping' we thought we'd go up on the weekend and check it out... How convenient, someone has dumped a HUGE pile of dirt on top of the stuff next door had already dumped, essentially covering any evidence of their initial dumping This pile is so large it's no longer just on our block it's also onto the block next to us (yet to be titled and pegged etc by the developer). So as the stage next to us is being developed at the moment for titling, we went to the office as the massive pile of dirt, for all intents and purposes looks the same as the dozen mounds of dirt piled up on the block next to us and into the distance. Nope they came back to us today, it's nothing to do with them either. So, if you're in Melbourne (even better if in the northern suburbs) and you've had dirt/fill dumped on your land which is so large you can't physically remove it all (without a small army), who did you pay to get it moved? Do rubbish removal places take soil as well as the piles of concrete etc? Sorry for such obvious questions but I'm just stumped as to who to get? Would it be worth talking to PD and asking to speak to the company that will do our site scrape (in less than 2 weeks) and getting them to quote to move the dirt etc? Put one at the entrance to the estate and one on your block. As for the other rubbish, well it looks like you will have to get rid of it yourselves Look in the yellow pages for skip hire and get one in for a day, go down there and fill it yourself. As I was doing my regular 'drive by' the block late yesterday afternoon (as you do...) I noticed a very large dump of concrete, stopped the car and checked it out. At first I jumped to the conclusion it may have been the builder across the street and down two, and decided to walk over the rest of the block for further evidence (or rubbish) only to discover some remnants of concrete that had seeped under the dividing fence, so it appears my next door neighbour has dumped the leftover concrete onto my block, not only one large heap but it's been spread around as well. I'm about to go to the block shortly, this time with camera in hand, to get some shots of the evidence and plan to type a short note for nearby neighbour's which I'll drop in their mailbox asking the guilty party to please remove their rubbish and refrain from doing so in the future as this doesn't help build a healthy neighbourhood relationship. Even though I am 99.9% certain of the culprit I'm not going to make the mistake of pointing the finger at one person. All of these neighbours need to take a look in the mirror because the estate has a NO dog policy which we all signed on the contract when purchasing the land, and guess what?? most of them have not only one dog, but sometimes two or more, one is a dog breeder (if my source is correct) and one or two have 'savage' dogs. Now don't get me wrong, I'm a dog lover and would dearly love a dog myself and this was the biggest consideration in buying this block, but if they are breaking their contract they should think about upsetting neighbours rather than adding fuel to the fire. Not a nice welcome to a new estate is it? They were a few weeks ahead of us, and everything they had excess, they pushed onto our block. So when we had our site clean, they pushed all their stuff straight back over. It is so rude. If anyone see's concrete trucks dumping concrete onto a clear block, I urge people to take photos and contact the company. They know they arent supposed to do this, but hey if it gets them home a little earlier, and they can get away with it, they will. I know sometimes I take things a little personally, but I was so disheartened when people dumped on our block. We live 45mins away at the moment, and both work in the city, so popping up to the block each day is not an option, but I was starting to worry that is what would be required to try and keep things under control. The good news is...our site supervisor called to introduce himself yesterday and hubby rang him today to ask what could be done about the dumped soil. Apparently they are going to take care of it when site scrape is done *breathes huge sigh of relief* I'm so happy about this. I really want to 'look forward' to the build process, but these last few weeks have been horrible because all I kept thinking about was all the crap on our land...
