Re: Building Advice & Concilliation Vic. 2Jan 04, 2010 8:32 am BACV was introduced after the disastrous reforms to Builders Warranty Insurance in 2002 left consumers (our clients) terribly exposed to * builders. Unfortunately the BACV process is based on 'good faith' and there are no binding constraints on either party to do anything. In the end, if you or the builder decide to dig in then you will be off to VCAT and for a serious technical issue then you can easily kiss $50K goodbye. I have been involved for the last 7 years in trying to reform this system however the vested interests (eg: HIA and Insurance Companies) hold sway with Government hence the status quo remains. That is, you have no real recourse against a * operator other than spending a small fortune at VCAT and this can take years. I have known far too many consumers who have virtually lost everything by pursuing the 'right' action. Be very careful. Often times, it is cheaper, quicker and less stressful to simply pay for the cost of repairs yourself and then have a crack at the builder for compensation afterwards. At least that way you are not living in an incomplete or defective home and you can choose to get on with your life because even if you win at VCAT, you still have to get the money - and this can also take a lot of time and ridiculous amounts of money. Has anybody tried to terminate their contract close to the final stage, declaring the builder is in 'breach of contract' and continued with rectification and works themself, invoicing the builder for the difference?
