I signed up with Hudson Homes in June 2021 with a fixed price contract valid until June 2022, paid the initial deposit, then went through the variations and signed the final contract, paid the 5% deposit (over $25k), and within a couple of months they came back to ask for another $85k. All this within the fixed price contract period, meaning before June 2022. When I asked for the clause that allows them to do this and objected to paying the extra, they stopped answering emails, no responses to documents submitted, and now have said they will not construct our house. And they have walked away with our $25k deposit. Absolutely awful. I will never recommend anyone to go with Hudson Homes. All our dreams shattered. They have pocketed all our hard earned money. I don't know whether they are still operating or have collapsed. But I will not be surprised if they collapse as no one will want to sign up with a company that does not honour contracts. The deposits paid to them is not safe as there is nothing stopping them from using the deposit paid by Person A to complete the construction of a house of Person B. There needs to be legislation that the deposits are held in trust so that these companies cannot use them elsewhere. Another strange feature of Hudson Homes is that we are asked to pay the subcontractors (such a electricity, aircon) directly to the subbies; I don't think this is covered by iCare insurance but need to check. It is much safer to go with a builder where all monies are paid directly to the builder who then pays the subbies so that the insurance covers these in case the builder goes into liquidation. The communication from Hudson Homes is just awful. I am thinking of opening up a business like Hudson Homes; take deposits from people and then just walk off. Free money. I am now in the process of taking Hudson Homes to NCAT to get my deposit and claim damages. What happened to everyone who bought is really sad, hope things get resolved. Unplanned rent, interest prices going up, and rental costs increasing are really hurting everyone. LKumar, you have spoken with our CEO over several months and he has explained the reason for this price variation. He then offered to substantially reduce the variation for you as a gesture of goodwill even though your fixed price tender had expired. The increased costs and time delays over the past 18 months have been very real and as much as we’d like to carry 100% of these costs, many builders are finding themselves in a position where they simply cannot. You have mentioned that you have taken this to Fair Trading. We are, as we have explained to you, happy to abide by whatever ruling they give. We understand that you are frustrated and that you would like to use this medium to publicly voice your opinion, however the comments you are making are not complete and nor are they fair. The contract clearly says "the contract price stated in this contract shall remain fixed up to and including the Tender Expiry Date stipulated in the Tender Document included within this Contract, being 29/06/2022 (“the Fixed Price Guarantee Date”). So the tender fixed price expires on 29/06/2022. The demand for the extra $85k was on 26/05/2022. This is more than a month before the expiry of the fixed price tender. The company workers and the CEO do no even know what comes first: 26 May or 29 June. No wonder there are so many problems. And then they are prepared to openly lie about this. Anyone wants to see the contract and verify the dates, just let me know and I am willing to email that to you or put it up here for everyone to see. Facts are facts. I got a H&L from them in Box Hill and now facing a 20% increase in construction cost. Any pointers to help with this situation? Thanks Nothing positive about signature. Signed with them in 2020 for signature on tallawong and is still not finished in 2024, 4 years later. They promised 2021. Ridiculous delays and they blame the builder Hudson Homes, saying it's out of their hands and they can't do anything. Stay away from that guys at all costs. They are delaying everyone with every excuse under the sun and almost never reply to emails at all. From many DA approvals to price increases and no reply emails they are ridiculous. I also believe the CC they need to do isn't going through because it looks like they have to start cnstruction with 20 days of that being approved. Anyone else building in Nelson rd Estate and am i reading correct about Hudson homes building there homes ?
