Did they pay any liquidated damages?
Browse Forums Building A New House Re: Darbecca Quote on Inspection Reasonable? 24Sep 11, 2019 10:04 am Yes, I had to fight with Metricon just to get the $5,000 in Liquidated damages. They didn’t want to pay that either. Their Standard tactics, I understand. Most people like me won’t even consider this when they sign the contract. Re: Darbecca Quote on Inspection Reasonable? 25Sep 11, 2019 10:09 am Norfolk myself I would personally be much happier to buy your house over other volume built homes,if you asked most on this forum whom have gone through years of stress and time and in the end,big dollars,I would happily pay 10 % more for a better built home with your balls and time ensuring standards were higher, false economy to many catch's you out, everyone needs to approach building making builders more accountable as you have done. Re: Darbecca Quote on Inspection Reasonable? 26Sep 13, 2019 5:25 pm smitho BTW chaz, have you asked Darbecca which volume builders should be avoided? I'd imagine they're in the most informed position to answer this question. I will ask them when I get to that stage of my build process (haven't even bought land yet). I can clearly state that they are in a very good position to guide you. Happy hunting with the land. Re: Darbecca Quote on Inspection Reasonable? 27Jun 13, 2023 2:44 pm Norfolk Housepect was about $500 per inspection report. These reports are not suitable for NCAT actions however, where expert witness reports are expected. I ended up researching the standards required, buying the tools and doing inspections myself early mornings weekly with the assistance of Metricons building manager who came onsite with me. How did you determine what is and isn't suitable for NCAT actions? I'd rather pick, from the start, the one whose reports will stand up if we get into a dispute Re: Darbecca Quote on Inspection Reasonable? 28Jun 14, 2023 8:34 am theotherengineer Norfolk Housepect was about $500 per inspection report. I'd rather pick, from the start, the one whose reports will stand up if we get into a dispute These reports are generally not enough to meet requirements as evidence of structural damage down the line. That would require specialist reports written for the express purpose of eing evidence. Those generally have to be asked for specifically, from appropriately qualified people. The building inspection reports completed by these inspectors is to help you manage defects in your build and give you the tools to work with the builder in addressing the issues. These reports and your subsequent communications with the builder may provide evidence of attitude towards the build and generall pattern of behaviour. I.e. an email from your builder claiming ao.ething does t need to done, despite the relevant ncc section being quoted with photo evidence of non compliance in the report. Proving that non compliance was the cause of some serious damage is another beast entirely. Re: Darbecca Quote on Inspection Reasonable? 29Jun 14, 2023 11:12 am Great answer from ponzutwo Just adding that the best way to think about it is that your independent stage inspection reports are for the inspections at critical points of your build to help management of building defects and are not legal purpose reports. Once there is a breakdown and a dispute develops then you will need a legal purpose report with expert evidence. Typically you will need an expert as opposed to building inspector and the content will be
Obviously expert reports require more expertise than just building inspector, take more time to prepare and are therefore costly. Obviously it would be too expensive and unnecessary to produce building stage reports where there is not yet a dispute. Building inspectors are merely checkers under building control for mandatory inspections and may have never built anything, or run a business, or dealt with building problems and disputes or building contract management and administration. Typically their qualifications are a diploma in building surveying and experience in building surveyors office. This is why so many times owners have contacted me when they were told by their inspector that their bus cannot take them further.
