Sent Rex an email over the weekend re stage 2 and received the below: there are no more hold-ups and drainage works have almost completed & December 2017 is still the target. Naturally contractors do not work on Sundays in particular & there has only been light machinery being used at present until the big machines arrive on site in a few weeks time. The reset of the estates are still working and the lame excuse for the delay will be rain. This is should have already been anticipated before the time line is provided. Guys who have lot in stage-2 need to start >>> knocking the doors around as this will soon lead to sunset clause for many people as it did for stage-1. Yes, lots of people were stung with nasty sunset clause which always work in favor of the developer. Who did you contact to put the pressure on when you were in this situation? Obviously Rex is worthless to anyone. I cannot imagine that the developers are going to respond to anyone's emails or requests. I drove into the estate today. I haven't been there in a while. The seems to be a lot more concrete stormwater pipework and pits on site to go into the ground. There's a lot more barricades up and 1 x extra machine which I hope is to start doing the stormwater. I can only assume the the sewer mains are complete as I think stage 1 runs through stage 2. Hopefully this is the case. The website is saying that works started 5 weeks ago, and the most recent delays are due to weather - no surprise there.!!! Also they are saying that works are still on track for the end of the year and titles in early 2018. You will need to do some digging around. Look i don't want to sound negative but i have heard so so so many excuses that they never end. Rain was one of them but surely they should factor this in before giving an expected date on the contract. Rain is only an issue when there is too much rain the rest of the estates are working and going ahead of them question is WHY. To me this is a deliberate delay. Now there is not much work required. The council should not be bugging them either because now that they have delivered the stage-1 the developer and council should be on same page. Once site completely dries up and they have no excuse (which i doubt) lets see if they can complete this in time before xmas from my experience when stage-1 was at this stage it took a little over a year. I see the site almost daily what i can tell is the work is very slow comparing to other estates. Contract finishes and money is handed back to you and you go home, no if's or but's. This is very rare only if the developer is an as.. and they want to give the land to a third party. In most cases everyone avoids this due to legal and court battles can start. People end up putting stay on the property etc. 2. Developer is interested in selling the land so they turn around and ask you to do a new contract. Now this is up to your negotiation power and knowing whats best way around. This new contract can be new market price or something you negotiated. In most cases both parties meet half way. say it was 300k before and new price is 400k you end up with 350k 3.if you have time and energy and willing to take the risk one can take them to court this will bring the price down or you may end up going with the old price altogether. At the same time it is risking as you may end up with nothing I would suggest speak to a family lawyer and estate agent don't go to a professional lawyer to consult otherwise they are out to make money and will only end up telling you that court is your best bet. Re: Greenvale Heritage Views 255Sep 13, 2017 3:22 pm It's just beyond ridiculous now, they are waiting for some peoples contracts to be up I reckon so they can use the clause. but as we have been told by the Forman on site.. the lands won't be ready till April/may next year. Or might be a little longer than that. His run out of money and cannot pay them. At the moment we are sitting ducks waiting to be targeted. I would suggest to ask your lawyer to send them a notice of explanation for the delay. |
