I managed to bump into the developer who had just finished a site meeting. He advised me that stage 1 has minor issues that the council wanted fixed which should be fixed within the next week. This includes things such as a sewer test and a fence being put up at the start of the estate on the right hand side. Compliance according to him should be given as soon as these things are rectified. In terms of stage 2, they have already started putting in the sewer and are awaiting drawings for another pipe that will run parallel with the existing property next door. As services are already running to to stage 1, he is expecting stage 2 to only take around 3 months depending on weather. Hope this helps, and also hope this weather goes away as it will just cause more delays! We want to get in touch with anyone in a similar position to see what our options are together. Caveats and class action suits are best used in numbers and it might be time to start considering it. We know there must be a lot of people in the same boat as us, we've all waited 2 years patiently and Rex hasn't been able to give us straight answers let alone the time of day. We were told multiple times the sunset clause would not be used and not to worry about it which we all know is now incorrect. We've joined this forum specifically for this purpose so please put the word out. One needs to find out why is this being dragged out. It does look like day by day that this is being done deliberately. Everyone one is being sent the bad news individually so clients don’t consider to take the action together. On the other hand one need to find out from the council why is this taking so long, because according to the developer they have completed everything and the delay is not because of them. Especially those who have lost their land due to the clause - I did't realise they could do that!! I drive past that estate everyday and it has been very slow moving. My sister looked at buying a block in HV early last year and she was told titles in August 2016 - luckily she had learnt from my own experience not to trust the developer and ended up buying in greenvale grange. I would definitely try contacting the media - today tonight - maybe? From my own experience the council and members of the parliament are not very helpful. We had an 18mth delay on our land (greenvale orchards) and then when we finally started building it was very slow moving and then our builder went under. We did get a bit of media exposure though. If anything it creates more awareness for people about to embark on the journey of building. The person handling the Plan number = PS735140k is called Michelle. In most cases no one will pick up the phone so you will have to go through main line (03) 9205 2200 ask them you want an update from the planning dept but no one is picking up (otherwise they will just give you the number and ask you to call them yourself). Once you reach the planning dept Michelle will not be available (ya I know what do you expect they are working very hard ..lol). You will be asked to put you name down for a call back. Please do that so she knows compliance needs to be given soon otherwise every Single one of us will be going via Sunset clause. It is NOT with the council so nothing the council can do. It's the same update I got 3 weeks ago. Please contact us we need to start rallying together. I am a purchaser of land on stage 2. It is horrible to see the situations done of you are at. I was in a heritage views yesterday day and I can see nothing happening at all. Stage 1 looks complete but obviously the council are still awaiting these rectifications to sorted. It has been sitting idle for a few weeks now. Stage 2 they have simply moved some earth spoil and began to peg some blocks off Alisha. But this is extremely slow moving. There only seems to be 1 excavator on this site which is very concerning knowing how much work is involved. Can anyone tell me in what section there sunset clause is mentioned in their contracts. I finalised mine with Rex July 2016. I have briefly looked through the contract but cannot find this clause ? Re: Greenvale Heritage Views 180Apr 10, 2017 9:11 am Good Luck to everyone in Stage-2. Speed they are working on and from the past experience Stage-2 regardless of what they say the estimation of completion will be Mid year 2018 (JUNE). Since winter is about to start and once the rain starts they will stop working. I am not being - ve just telling every one hope for the best and prepare for the worst. Stage-1 was at this stage in June 2016 and the update was posted on the website in Aug 2016 when the earth had started to move. Keep in mind Stage-1 is still not titled yet. They keep saying the same thing it just about to title in 2 week for the past many months. |
