Long story short they must not place conditions above the normal as well as disadvantageous to developer by unrealistic conditions If you have the ability to prove that others have not done the same they are required under the state planning act to review that condition. What ever they do get it in writing for the PCI My partner just out from council and its being referred to their senior building surveyor. Waiting now for the bloke who looks after the area we built in to get back to us (as it has changed from the original bloke). The guy at council said we may be able to claim financial hardship (because we literally have to pay a full morgage plus rent...no possible for us). Do you have a reference to this clause? They poured their slab before us and they haven't got their frame yet. never thought beechwood would be quicker than another builder. Not sure how long this will last. They have so many issues & they didn't notice things we pointed out. Bricks not cleaned properly & in places not at all, their corness in the lounge room on one wall has a bunch of bends in it, the downpipes are the worst paint job I've ever seen. Last week they had their tiles done & the 2 niches in their ensuite has feature tiles in them & they are the wrong colour... turns out the tile place got 2 numbers around the wrong way on the order form. They are now being redone in the new year. As soon as we got home hubby went over to the painters & told them we had just seen another Beechwood home & we will not be excepting any crappy paint job on the downpipes. I hated living on site with our build until today. Update on my build... painters here this week & they got shreds ripped off them from our SS & the boss of the SS's because they didn't cover our kitchen completely up & half of our cupboards have over spray on them!
