We are planning to build an extension at the side of our house which is a corner block. This is Boroondara council in Victoria. The requirement for a side setback is 2m. Our proposed single story extension is 1.5m from the boundary, however adjoining the boundary wall (which is just 40cm high) is a 50cm wide garden bed (see pic below). Not sure if this is on title (will have to get a survey done). If I include this garden bed then the setback from the footpath meets the required 2m. Could anyone share their experience/thoughts on whether we can get our plan approved or will Council simply reject it straightaway? Thanks for any advice. .
