Our contractual completion date was 25th July 2016, and as we had to build our retaining walls in the beginning (back in March).. and the wall was built by end of April. They are requesting an extension from mid March til Mid May (2 months). Just a quick explanation as to why it took so long, it was because Coral Homes Office Admin girls made a complete mess of our Retaining wall design (plans) and removed the rear wall without getting this approved by CDC Certifier. This caused us to have to have the whole thing redrawn, re-approved. They messed it up a 2nd time so we had to wait another almost 2 weeks to correct more mistakes. We built the wall with poor weather in 3 weeks total, but 5 weeks was then screwing us around hence the 2 months it took.!!! We received 4 extension e-mails from our ss, but we haven't received any of the extensions within the 10 days time frame via formal variation to contract. We just wanted to ask you guys, when you got your extensions removed because you didnt receive the written notice within 10 days, do you know what is the "Definition" of written notice? [/quote] Hi michaelandkaty, Thanks for your response, We rejected their request for the 2 months of extension for the delays in retaining wall build, and the great news is today we got an e-mail back stating that the extension has been removed. We won in this case, but they also didnt notify us in 10 days in any form for this particular extension. We now have I think 3 other much smaller extension requests that we did get an e-mail within the 10 days, but did not receive the variation to contract for us to sign off on. I suspect from a legal perspective, the term 'written' in this day and age would generally be accepted to include email, given that it includes fax already anyway. I imagine that so long as the notification is sent via email and provides everything required by Clause 13 of the contract (extension of time) then this would be accepted as written notification. WHAT IS ACID BURN? Acid Burn (Iron oxide stain) is the formation of a yellow, orange or brown rust like stain that occurs on the face of the brick which may also leach into the mortar joint, casued by the reaction between the iron oxides in the brick and/or motar sand and hydrochloric acid application. Acid Burn can result due to a number of factors, the most common being: - Failure to saturate bricks thoroughly with water before the application of acid. - Failure to rinse of Acid thoroughly after the process. - Failure to perform the neutralising process when required with high iron content bricks e.g. Queensland Bricks. - Working in the direct sunlight.
