We have an Easement to runs the length of our property (from the back corner to the front driveway), this is marked as a Drainage and Sewerage Easement in our Section 32 and also on our plans. We have just called council with regards to obtaining a Drainage Permit and they have informed us that we can't use this easement that we need to use the Easement next door, although I do not totally understand why. The council said we should call our lawyers to contact the lady next door to use tapp into her Easement - lawyers? really is this necessary, shouldn't we just discuss it with her in person first and see if she is going to give us any objections. My issues ... 1) If we have an easement, why can't we just use that 2) I have previously built 2 houses and have never had to organise a 'Drainage Permit' is this something that the builder would generally organise? 3) Is she allow to deny us access, considering she doesn't own the pipes, the Water Authority do.
