Browse Forums Building A New House 1 Mar 29, 2010 10:23 am Hello ! Ours is turning into a woeful saga ... Builder has quoted $7000 as Tender Expiry for 12 days delay!! We signed building contract with our builder late last year and then embarked upon requesting DA approval and Internal Colour Selection. The process was slightly different to the standard whereby contract is signed after the DA approval and Internal Selections are done for us to be eligible for First Home Buyers Grant. We finished all items required by the builder except for the Internal Selections by the tender expiry date which was also completed in 12 days of tender expiry. The builder along with pricing all the variations, has quoted $7000 for tender expiry!! $7000 for 12 days of delay??? There is not much point in playing blame game as the builder is not willing to accept that ANY delay was contributed by them. Surely we cant talk about ethics when its comes to building industry..so leaving that apart, do we have any options here…….are we protected by any HIA clauses or is it all upon builders whims and fancies what they quote after the contract has been signed for 12 days of delay? Any lawyer out there, anyone in similar situation wants to comment? Re: Missed tender expiry by 12 days ..... plz help !! 2Mar 29, 2010 10:57 am Our contract has an "Agreed Damages for Delays" section (standard HIA contract) which is equal to the builders late completion amount which is $300 a week, this sounds a lot better than $7000. We also had a document that limited any price increase to $1,000 or a number that required full back up as to costs if we delayed signing the final contract. Our bank took 6 weeks to get the finance formally approved and then there was a delay getting the plans from the private certifier to council - the price review date is in 3 weeks and 2 days and the plans have only just hit council now (we have been told around 6 weeks to get through council), so the odds of getting the plans approved by the date are pretty much non exisistent and we have to cough up an extra $3500. Ours expired for 10 months after the initial 120 days fixed price period and during that time builder claims there were 3 price increases (every 3 months seems to be a price increase), we got hit with $7500. I did walk in to builder's other display home and picked up the same brochure of the exact house we are building and it did increase by that amount. I have learned that you need to be on your toes and be more proactive so that you are always a step ahead of your builder and ready for whats ****** ahead. madcow, we missed our tender deadline only by 12 days and everything specified by the builder, signed HIA contract, received Council approval, internal colour selection, electrical selection, construction loan approval was done by then.
