Browse Forums Building A New House 1 Aug 18, 2020 11:53 am I have had to terminate my current builder for two townhouses midway through the frame stage due to poor performance. My question is has anyone had experience of the process to change over builders and how was the line of responsibility drawn between the new and old builder? For context 1 - Termination was the last option after many months trying to resolve the performance issues of the previous builder. The situation with the previous builder is irretrievable 2 - I have had several quotes from other builders to take over the work 3 - The problem I have is that the contract offered by the builder is very blunt that I has an owner have to warrant the works of the previous builder. I am not a builder and can't warrant what the previous builder has done. I have suggested an engineer investigate the works and draw a line between the works by the previous builder and the new builder but have had push back. Keen if anyone can share their experience of changing builders mid-build what was the structure of the contract to distinguish between the old and new builder. Tricky bit is the 'Warranty Insurance' the frame is built by the old builder and fit out is by the new one. If there is defect where to draw the line, is there a permanent grey area? Could there be an intervention that helps solidify the line as much as possible?
