Two driveways across two properties. 1) With regard to the damage to the driveway, if you broke it, it's probably your responsibility. If you didn't break it, it has nothing to do with you. It's common sense - you break it you pay to get it fixed. 2) With regard to your driveawy, why not link into the crossover in front of your house. I'm very interested in hearing what Council has to say. If it's not approved by Council I would say it has to be removed. If she goes quiet, you know she built it illegally. Ask it in a way that you sound innocent so she thinks you are doing her a favour. If you had plans for that space no way should you have to cop it. Is there anything in your contract that stipulates common access areas? For someone else to share the easement I think it needs to be spelt out in the contract. Re: Neighbour's driveway extends over my nature strip 33Oct 22, 2012 7:58 am i its anything like our council god help you lol last pieces of advice are the best i reckon ask to see the council approved plans she had when she put it in when she says why or tells yo to go jump you can show her the prints outs from the links back on page one that someone posted about the regulations about your driveway entrance on council property if she fires up or comes up with excuses you then know, for sure, that she had no approval and just went and did what she wanted to do without thinking about her neighbour if she didnt get permission, i would go and get permission for what you want to do on your entrance and just do it, if a bit of hers is in the way then too bad...just get rid of it will certainly cause a fight tho obviously she didnt care about you, her neighbor, then maybe you should return the favor??? the best bet would prob be get your council info and confront her with it then take it from there and get back to posting and telling us what the council said interesting situation good luck Re: Neighbour's driveway extends over my nature strip 34Oct 22, 2012 8:28 am If they wont answer i would submit plans and see what happens Surely they would check if they have already approved something and cross check to see if your plans intefere with them..... i guess we are talking about council though arent we...... Apparently the (vague) drawings for her house did show an encroachment across my nature strip, and that's enough for the Council to say it's kosher (apparently it can go across up to five metres!). Worse still, I'm responsible for damage on my side of the nature strip, so will have to have it repaired. Even though I don't want it there, and even though it's technically not mine. Deep breaths... So, it looks like they assume that you got the letter (or you got the letter) about her intentions to build and you did not make any submissions - meaning that you practically agreed to her driveway intentions? That's a pitty. Now, as ^^^ peeps say, can you make application to have it removed from your land? Hmmm they probably won't approve it because they already have the rule that allows it.
