Do awning windows for BAL 19 have to be toughened?

Trying to get our head around BAL 19. It is very confusing. Does anyone have particular advise about awning window requirements?
I agree the requirements are confusing. Glazing less than 400mm from ground or decks must be 5mm toughened glass or have external metal screens
However it is not clear what happens above 400mm.
Possibly the supplier of your windows can advise.

You also might want to check with the Insurance Council of Aust
