Need Advice wrong Insulation product used

We entrust our first home with a builder.
The house was found out not to have any star rating but the builder said it was designed using DTS (DEEMED TO SATISFY) method when we ask.

We complained about house poor thermal performance specially during cold winter.
The builder said they will overlay another R4.0 insulation on existing ceiling R2.8 insulation which is tested as faulty product.

The wall insulation was not in compliance also as its only R1.7 as supposed to be R2.5 per build plan.

Is it enough to make the house rating change from DTS then with just additional R4.0 in ceiling the house will become 6 star??

Black roof, bare Color bond, single glazed Windows, no slab insulation etc.
Unfortunately, if you are going to prosecute ( energy) in the WA building commission I don't like your chances
For a gas producing state, energy home efficiencies doesn't carry the same weight of importance as our eastern States counterparts who rely on overpriced housing and associated industries.
OT 6+ star house rating system is a bit of a joke here
