Section 96 DA Amendment - how much can you change?

Hi All

A question for anybody that has dealt with a s96 amendment to an existing DA.

How far can you push the amendments and still fall within the S96?
eg: can you extend an exterior wall, say 3m, to give you more room on a floorplan?
- Extending garage 1m?

All other controls will remain.

A section 96 or " modification to a consent " means minor changes to an approved DA where the changes are consistent with the original DA. Usually if the changes are minor as in making a 2000 x 1200mm window 300mm bigger , then the council or PCA will just ask for an updated copy of the plans and nothing else not even a section 96. Anything more and they will want a full section 96 with all the original documents and the changes.
It usually is concerning the effect of these changes on neighbouring properties - privacy and solar access etc.
If these proposed changes won't affect anyone else then the section 96 may well be approved easily.
I'd take a copy of the original plans and go down to your council for their advice.
