The height of the wall will set the minimum setback from the fence, which you could look at getting an exemption assuming you can reach an agreement with your neighbors. However any closer to the boundary and you'll run into issues with solar access to their habitable windows (marked hab on the plans) which again if you can get an agreement you may be able to get an exemption for. However looking at it from the perspective of the lot 718 owner, by allowing that they'd effectively be cutting out any direct sunlight to those rooms, so in all honesty I doubt you'd be able to reach that agreement. I'd expect that is also what the builder is working on, technically you could go through the process of trying to get an exemption but the likelihood of it being agreed too, is so unlikely that it isn't worth the effort just to get a no. Alternatives you could try speaking with your neighbors directly. Show them the plans, be upfront about the overshadowing etc and gauge their response. If you can get them onboard, then go back to the builder they'll be much more willing to try for an exemption. Alternatively have you spoken with the builder about other options with extending the garage? Perhaps to extend further down the side of the house, you'll run into other limitations with length along the boundary but it may be a way of getting a bit more space. We were told the garage and the right side wall will cast a shadow into their private space and so forth. I think i will have a talk with the neighbours and see how they respond to it. I Re: Shadowing of Neighbour's yard 8Oct 19, 2012 10:22 am Thanks for publishing the plan. Just did a quick layout of your build and the surrounding lots. Assumptions: building height were base on 2.4m ceilings and a 15deg pitch roof. Sept 3pm shadow lines - worst time of day Didn't look at lot718 but 9am shadow will cover all D/S windows on their east walls Your build faces almost due south The garage roof does create a shadow on the floor of lot714 under cover area (UCA), but only about 350mm into it. This roof does not shadow any of the windows and only shadows about a total of 28m2 of lot714. If overshadowing is an issue you’ll be creating more of shadow on lot 715 (especially it’s 2 HAB windows on the one wall) from the roof line above Bed2 and the activity area (running NS) than the garage roof line on the boundary. Ask your builder for the shadow diagram. It takes stuff all time to produce any will ‘highlight’ (I know, corny but hey!) what the issues are. Also find out what regulations govern your area in regard to overshadowing. Another course of action is approach you neighbour in lot714, explain that you want the garage wall on the boundary and see if they consent. So looks like we're going to have a 1m gap instead of a 2m from the boundary to the garage wall - which I can live with now A common sense result that everyone is happy with – all from a project builder. This was a good demonstration on how to deal with a project builder – don’t take what they say at face value, stick to your guns and you should be able to get something you’re happy with.
