Yes, We have an investigation report from building inspectors Houspect, are following the dispute resolution procedure in our contract to the letter, as well as asking NSW Fair Trading for assistance. Metricon are legally obliged to build all houses to Australian standards, of the workmanship displayed in their display homes, and as per the contract design. We are obliged to pay Metricon the progress payments when the stages have been completed properly as per above. This is an unusual and fortunate situation because we have identified the problems early and Metricon has the opportunity to fix them before the fixing stage progress payment is due. It appears most customers don't identify the defective workmanship until its too late. Despite their tactics to 'push on' and cover things up, they cannot continue building without fixing fundamental defects like straightening the frame, for example. If Metricon can't produce a written plan of how they will fix the defects then this will be considered a breach of the contract and we will take the appropriate action.
