Anyone here able to advise.
Long story short, we're KDR in an established suburb, 3 x re-establishment surveys have advised that our neighbour has 200mm of our land. We're ok with that, not going to try and reclaim it back. Houses were build in the 1950s.
We're building to the 'boundary' on that side, so technically 200mm setback but flush with fences. Neighbour has a solid, metal gatepost (fully concreted in etc) and Metricon want him to move it as it will impede on the guttering. It's been there for 10+ years, we didn't know that it would have to move, and neighbour is solidly unimpressed. Don't really blame him.
I'm taking the view that it's Metricon's problem as it's an existing structure and they should do something such as box gutters on the inside of the garage vs. overhang gutters - for example, neighbour's brick garage wall is entirely on our side land, but it's been there for 40 years. Ain't going anywhere.
Will call Darbecca again tomorrow to consult but looking for expert advice...
