Browse Forums Building A New House Re: Fence before build - neighbor dispute 27Mar 29, 2017 5:26 am Berek That's fine, your child you pay. If a neighbour came at me with attitude I'd give it back. I like fairness. I like playing by the rules. But I'm not responsible for your kids. Edit: That sounds a bit harsher than I'd usually frame a post but looks like I'm in the minority I totally agree with you, my child solely my responsibility. I wouldn't come at my neighbour with attitude only if the neighbour was being an unrealistic a hole then I would throw shade. I don't get why the OP is against paying for the fence when they are legally obliged to pay for half. If it was the other way around and they wanted the fence up as they are finished and ready to move into new home but the person next door was like well no because I'm not building yet so you'll have to wait - I don't really see that as fair, having to wait for that persons share of the money GJ Gardner Modified Coolum 277 viewtopic.php?t=83643 Re: Fence before build - neighbor dispute 28Mar 29, 2017 8:36 am Rocchet Hurrow What happens if you're building a house in a new estate if the land next to you hasn't been sold yet, or isn't even under development yet? I'm likely to have 4 neighbors who I'm sharing a fence with. One block next to me has been sold, there are another two blocks on a side but these haven't been sold yet, and behind me isn't under development at this stage, but will be eventually? If it makes a difference none of the blocks that have been sold have even titled yet, and nor has mine. If developer owns the land next door you will need to cop the full cost I'm afraid in every situation I'm aware of. If neighbour hasn't titled yet my advice would be to get their contact details from the estate and forward them 3 quotes as you are going through the process of putting up your fence. I think you will find neighbours will pay and are obligated to regardless so long as they are in full ownership of the land. If not then they will be at some point. Worst case scenario you may have to wait until they do. 3quotes is key and if they find a cheaper one than your 3 they are only obligated to pay half of their quote unless agreed otherwise prior. Good luck That's about what I figured would be the case. Hopefully all the blocks that are for sale will have sold by the time we finish building, I'm not getting my hopes up about the one behind us that hasn't been developed yet but we may get lucky there I suppose. It wouldn't be ideal if we had to pay for it all ourselves but it is doable at least, fencing doesn't seem to be that expensive from what I understand. Building a Kew 28 with Porter Davis Re: Fence before build - neighbor dispute 29Mar 29, 2017 9:23 pm Can it not be settled amicably? I know there is a rule that fence is shared 50/50 but what if you still don't have the funds? Maybe the reason they are not yet building is because of funds? Can the other neighbor then just pay for the whole fence provided there will be an agreement between the two that the other will pay once they start building?
