If it's any sort of metal, the panels should just come off... is it wood pale? If so, you should be able to remove the palings by sections and have the posts and cross bars replaced (at her expense, I would think). A wire net fence would be something else, but any competent fencer should be able to remove and replace sections of fence, so you wouldn't even know. A brick fence can be taken down and rebuilt beautifully by a good brickie, with the same bricks. She may be saying 'cut', with no true understanding of the construction. The legality would depend on if it was necessary works, I think, like having to stabilize her house vs wanting to terrace the garden. I don't think you can prevent her saving her asset if it comes under 'necessary' works. Then you have to consider if it's worth making enemies, especially if she's a little loopy. Why did she wait 'til now, instead of talking to the previous owner? Seems odd. Whatever it is, if you let her do it, she can pay for it, (get that in writing!). However, speak to a fencer first, as I can only surmise, seeing as you haven't said what type of fence it is. It depends on what she wants done, as to what damage there may be - if it's a small bobcat, I wouldn't worry, as your builders will pretty much tear it up anyway... I'd certainly supervise and take pics, if you do allow her to do it - during works, as well as before and after. It's a bit of a can of worms - do you know if she's going to excavate a lot, or if a little dingo digger can handle it?. It may be an issue for you, as any excavation can affect the stability of your land. Emailing your council about it would be best; at least there will be a record of you making an attempt at finding out/being reasonable, if she wants to make trouble later. It wasn't for necessary works, she just wants to do her gardening even thought she has a large garage and can access her garden through an extra roller door. I told her I wasn't prepared to have her cut the fence down and go onto my land for a number of reason especially because I will be building very very soon (just waiting for the slow slow builder). I went for a driveby and saw monster trucks parked outside my house and 2 large bulldozers. They have not entered my property thank god!
