Browse Forums Building A New House 1 Oct 27, 2015 9:53 pm Ok so either house to the right and lwft of us have been built. Their retaining walls and fences have been put up without us knowing. They havent notified us or sent us documents asking if we wanted their certain type of fence and retainer wall colours etc. They just went ahead and did it to their own liking. Now the builder is trying to play scare tactics and request half of the retainer and fence within a 7 day payable invoice. Wtf?? Of course i gave the builder a bunch a f offs. Now i understand we are within our rights to say NO because we wernt issued with documents and quotes prior to this work going up. The builder is trying to hit us up with being bad neighbours blah blah blah... we wouldnt of had a prob going halves if we were included in the selection process as its half of ours aswell. We want to do the neighbourley thing. But since the neighbours decided to do their own thing and want half after the fact its done is beyond me. Im prepared to say Stick it to both sides if they want to play that game. Any1 had anything similar like this? If so what happnd? Retaining walls are a bit different in that each party is responsible to retain to the "natural" ground level. So if your block is uncut and your neighbours either cut down or built up theirs, then the retaining walls are their problem. I'm building in Ipswich and had to build a retaining wall at the back of my property. It is completely my expense and not my neighbours. In regards to the fence I was told by my builder that if I Just went ahead and built it without giving my neighbour 3 quotes for the basic 6 foot fence, I'd have no chance of recouping any money from my neighbour. I was told to wait, get the quotes and my neighbour just has to pay half of the cheapest for the basic fence. I'd be telling that builder where to go. In this case, you are not even informed or given quotes to anything. Your neighbour has to pay the whole bill. Also, it is your neighbour who has to ask you for money not their builder. Their builder simply cannot act on their behalf in getting any payment from you without agreement. Yes the neighbours have seen us at the land and havent approached us at all. Im 100% keen to be neighbourly but not really after all of this.
