Browse Forums Building A New House 1 May 28, 2015 5:08 pm Hi Guys, First time poster, long tom reader I am currently at tender stage with Mainvue on an Amalfi 632, and one of the requirements that came back was that there is a small space alongside the side of my house that is to be fenced off due to design guidelines of my estate that can only be accessed either via a gate, or via a roller door on my garage. Mainvue has come back to me and stated that I need to include a door that opens out on to this space as part of the private open space regulation 421 '..· convenient access from a habitable room (other than a bedroom)...' Now the space can be accessed easily enough via the alfresco, albeit via a gate at this stage, but I am just wondering rather than via a gate, can we use privacy screens to be more convenient to adhere to this regulation..? I'd really prefer not to have doors on that side of the house! Has anyone else dealt with this before? TIA Re: Query on PRIVATE OPEN SPACE REG. 421 2May 28, 2015 5:37 pm Hi, No need for privacy screens as it has nothing to do with "privacy" rather that it is an area for your own private use (hence it must be at the side or rear of the property and not out the front of your house. Edit* although reading the Victorian legislation they do request for it to be secluded, so maybe your screens might make them happy... There may be someone at Council who could help with what they'll accept. I would ask Mainvue how they normally deal with this regulation if they're not allowing access via alfresco - is it because your gates shown on your plans? If you have space to the side or rear of your alfresco that is wider than 3m and covers an area at least 25m2 you should be able to argue it has convenient access via alfresco from a habitable room (based on my quick read of Reg 421 and the point about habitable room) Hope this helps...
