Its hard to give a definitive answer from the photo, considering its a metal roof its probably OK..Besides its now covered up too late for site inspection now? The Builder can deviate in regards to minor construction or structural matters if advised to by an Engineer. Firstly you are looking in the wrong place and not asking the right person. Here is the answer: 1 Building defect is defined by law. 2 The relevant law is Domestic building Contracts Act 1995 3 Definition: "defective, in relation to domestic building work, includes— (a) a breach of any warranty listed in section 8; (b) a failure to maintain a standard or quality of building work specified in the contract;" In addition, there is protection of Division6 in relation to display home: "The builder must construct the home using the same plans and specifications and to at least the same standards of work quality and quality of materials as were used for the construction of the display home." Defective work as to implied warranties means more than that... those listed do not include all of them. For instance... systems and materials when installed must be able to last a reasonable amount of time, not just 6.5 years. This brings up the topic of inferior alternative solutions as well. It is not all covered by law as to the spelling out of these matters in detail. What's more Contracts based on the Act just mentioned do not define specification adequately. There are precedents on the basis of reasonable life expectancy in VCAT and the Supreme Court. That is not stated in Section 8. And why is the very definition of what building consultants are looking for ... namely DEFECTS not relevant to this post perhaps more than any other??? A building inspector and Building Act wont be able to help you. Please consult an engineer and lawyer. Will mean that at least if something is found and fixed that it doesn't reflect badly on him but that he's done a good job. I would be much more concerned about the SS having little confidence in his own ability as well as his non acceptance of the new home owner's legal rights.
