They rely on the Bureau of Meteorology reports for your area. Rain days are not based on trades being booked that day but being unable to work. Thx Pommie, I think it's luck of the draw on whether your build comes in on contract time or not. Our 2 story house was 200 days (i.e. 10 months), we are at 17 months and still trying to get M to finish off the last of the work. If I was ever to do this again I would demand higher liquidated damages and a cap on rain days in the contract. And they can't really claim once the roof goes on! Claimed as they occured and we received a letter every time they claimed one. I think we had 9 rain days all up, our building period has been Dec 2016 - August 2017. We were advised of some rain days when they occurred but were hit with a lot more at the end of the contract when M were calculating our liquidated damages. Every rain day saved them $50. They claimed rain days right through to keys. They claimed rain days right through to keys. Hi Gibson, How can they hit you with rain days at the end of the project if they didn't notify you when the rain occurred? They need to let you know when reasonably possible of the extent of wet weather, so if it rains when slabs going down they can't wait until just before PC to claim the delay as they obviously weren't delayed then and are just trying to minimize liquidated damages. Whether they actually start or not on day 20 doesn't matter , your contract build time starts there. Sevenths, rain days have nothing to do with them not being able to work safely on the site and everything to do with extending the allowed build dates and minimizing liquidated damages. The contract says they are entitled to rely upon meteorological reports when calculating rain days at the end of the contract. Hi Pommie , You need to meet what ever your contract conditions are to make the land ready for M, i.e. DA approval, demolition completed, demo certificate, block cleared, trees removed ... You then tell M you've done your part and they take possession of the site at which point their 20 days starts. Generally you'll get fencing and a port-a-loo within a few days. Then the survey pegs, then they mark out the foundations. If they start work within the 20 days then that's your contract start date. If they don't start in that time your contract start date is day 21. Hi Gibson, all I was pointing out is that they cant run late on the build and then say "oh it was wet weather 6 months ago and we now want to claim a delay", as it doesn't work like that.
