SM promised the things will b fixed after hand over with no worry at all. I am stupid enough to believe their words, and now stuck to uncompleted house. Many things are defects/ wrongly installed/ and missing from the contract. Eg. Fly screen door is missing. Privacy lock for bed rooms are missing. Wrong type of lock for the entry door. Crack drive way Poor brick motar work. Ceiling water damage from roof leaking. Missing gas pipe in alfresco. Broken down light since before hand over date. And many more.. All over 30 in the list. Another problem is their lack of communication. 5% chance that they will pick up my call or return my call. The supervisor always cancel the appointment without notice. I just wonder if anyone could give me an advice how to dealing with them. Could i use any lawyer service with them? Because i have paid full amount for the house already but 1mth pass and many things still left unfixed .. And unknown when it ll b fixed.. what can i do here? I call their office and staff told me they only deal with the paper work, which is done after the settlement date. They ask me to contact building supervisor who 5% answer my phone or call me back. Yesterday i call him and he said he ll come to my house at 3pm, so i call him today at 12pm to confirm the time.. No one pick up.. I call at 1pm .. Still voice mail. I call 2pm no pick up.. I call at 3pm no pick up and he didnt come. I wait until 4pm and he said he ll come late afternoon. I wait till 6 pm and call him.. No answer.. I text him at 7pm let him know that i ll b home until he come. He text me back "ok" I wait until 8.30pm and text him again if he can come. He said he cant I ask when can he come ..or how about weekend. No reply after that.. My friend says you can find who is the registered builder (or "DBU", Domestic Builder Unlimited) and contact them directly. That person has personal responsibility for all houses built under his registration. His information should be in your contract. The other thing to do is keep a log book of everything that happens. This will end ugly. He is not your friend and you are a consumer. Download a copy of building codes and tolerances immediately. Find everything wrong re: defects and uncompleted works. List them in detail and take photos. As mentioned, keep a detailed diary of every phone call and conversation re your house from now on. record as much as you can because they will make false promises. Now send it REGISTERED MAIL, no more phone calls. If you have a lawyer friend get advise re: how to word the list effectively. They have 3 weeks to reply. Do not let them stall and start making false promises. Read old VCAT rulings. You will be sick when you read the Domestic Building List, read the rulings. You must weigh up if the whole process is worth the fight, emotional stress and money. DO IT NOW!
