Browse Forums General Discussion 1 Mar 16, 2011 8:59 am Hi I signed up with Property Planet (Tru-Built) homes in November last year 2010, picked the colours in early December 2010 and nothing has happened. They have not started with any building at all. Why is it taking so long? What can I do to speed this up? Is there an Ombudsman that can assist with this? When I originally signed a 200 page document when purchasing my house back in Nov 2010, Property Planet would not give me a copy of this signed document. I did not have the opportunity to read this. I felt pressured to sign it. The girl just said everything is okay, just initial here, sign here. I finally insisted for a copy, before I left, but Property Planet said they would email it to me. Surely they should give me a copy of this signed by me and them, there and then. Not just a copy unsigned sent via email, as there are no costings on an email contract. Property Planet have told me different figures and prices, I don't even know how much the total costing was for? Property Planet said that a mistake was made and got me to sign another form. In reality you shouldn't have signed anything until you had read the document, but to late for that now. Personally I would be on the phone to them twice a day until I got a copy of the documents that you signed. Doesn't matter if they hate you. Read them cover to cover to see what the hell its about. If you don't understand it (don't worry none of us do), hire a solicitor. Will cost you a few hundred, but you need information at this stage. If they wont give you a copy, hire a solicitor to call them. They HAVE to give them to you. From there you will know where you stand. My builder did a very similar thing to me with the contracts. Maybe you need to front up to their offices and stay put till they give you lots more info and a contract to read. Can you get out of the contract. I think a solicitor is the go here. Go to their office and don't leave until you have a copy of your contract, it is within your legal rights. If the land your home is being built on is in a new estate, the time elapsed may be nothing to be concerned about. It could be that the subdivision hasn't been titled yet. You should still have copies of any documents you've signed though, as everyone else has said. Send the company a written demand (by registered mail, so they can't claim they didn't receive it) for copies of all contracts etc signed by you, and tell them that if you don't receive them within 7 days, you will be contacting Consumer Affairs to voice your concerns. Make sure you follow through if they don't respond. I'd try that before going to a solicitor; it won't cost you anything except a further week of your time. We also completed pre start in December so I dont think you need to panic just yet but I would definitely get written confirmation on a start date from your builder and/or developer. My builder provided copies of the initial preparation of plans document and the actual contract all within 4 days of me signing them. I purchased my land in Oct 2009 and they started the site scrape in Feb 2011 I have been given all my files , documents etc and i always get 2 copies (1 for me 1 for builder) and in some instances +1 for the bank. I havent had any thing bad happen with the builder. They answer emails when i send them, reply on the same day and have handled all requests ive made in a professional manner.
