We were wondering when the agent would give us notice of the open houses for this coming weekend (tomorrow & Sunday), and they're obligated to give 24 hours notice, but we've requested nicely that they give us as much notice as possible. Anyway, we got our notice today (the absolute MINIMUM they have to give us, thanks for that). One of the 2 agents called my partner and told her it'd be at 12-12.30pm both days (TOTALLY inconvenient for us, but what can we do? We have no choice. They never negotiate with us. We've already told them POINTLESSLY that 11am is best for us but they are deaf to what we want), and when I came home the Form 9 was under the door, but it said 11-11.30am so I was like, what?? I was PLEASED cause it's a good time for us and the Form 9 is the one we have to obey, you know? Not telephone calls and the fact the board outside had a sticker that said 12-12.30pm. That's their issue. Anyway, so we went by the Ray White office tonight and asked the (very rude) woman there about it. She said she'd call the agent who is in charge of the open houses this weekend. He said the PA got the form wrong and she'd put the time for someone else's inspection on our form and our time on their form. Our time IS actually 12-12.30pm. I said NO, the Form 9 says 11-11.30am so THAT is the time you are ALLOWED LEGALLY to enter the premises. The agent said no sorry, it has to be 12-12.30pm as this is the time on the board and printed in their open house brochure for the weekend. I have been saying many rude words about this. I cannot get over the fact that we clearly have NO rights in this. The only rights we DID have were the Form 9s, but now Ray White are COMPLETELY ignoring them too. This Form 9 for the weekend's open houses (that says 11-11.30am) is completely VOID and INVALID if they come at 12-12.30pm. THEY ARE NOT ALLOWED ENTRY TO THE PREMISES AT 12-12.30pm BECAUSE THE FORM DOES NOT STATE THAT TIME!!!!!! Why should WE be responsible (punished and have to be doormats) because of THEIR inter-office mistakes?!?! It has NOTHING to do with us what they do. If they put the wrong time on the form, NOTHING to do with us. If they put the wrong time on the board, or the time in the brochure is wrong...TOO BAD. The Form 9 is ALL we have to look at. Are we within our rights to lodge a dispute with the RTA now? How the hell did I become a senior member!? I know nothing! I sort of think it's important, not because it's incorrect, but because they insisted against our wishes that they come in at 12-12.30pm despite the fact the Form 9 said 11-11.30am.
So they were permitted by law to enter the premises at 11-11.30am as per the form, but they came at a time not specified on the form, and gave us no choice, and THIS is my problem. And no, no Form 10. We won't ever get one. They're also supposed to be giving our rental agents copies of all Form 9s they issue, but our agents have received none. What makes matters even more annoying is today we had planned to speak to the agent about it, saying we didn't have to legally let him in today and he better bring a proper Form 9 tomorrow or he wasn't coming in at that time tomorrow, but he spent most of the time outside, with people coming through (well, the ONE person who came. That's another issue we have with all this, which I'll get to in a second), and then the minute he was around and free, his phone rang and then he hastily left, completely avoiding us. But not tomorrow. We will follow him out when he leaves if required. Anyway, ONE person came to the open house. The same as last time, when one person came Saturday and 2 on Sunday, none of which were interested. The agents for some unknown reason do not advertise the property anywhere except online and their own open for inspection brochures. They do not put it in the paper or in their open for inspection section in the paper. We don't know why, but this would possibly explain why nobody ever turns up to the open houses. Every single time people have come in, it's simply because they're either neighbours or have happened to be walking by. They're not actually interested in buying, they're just curious. I think ONE person this whole time has been interested, and because they didn't put the price in the ad (which was in the paper that one time), they weren't suitable either and left quickly upon learning the price. So we're being inconvenienced week after week for nothing. Why aren't they advertising properly? Why can't they get the simple Form 9 right? SUCKS! How the hell did I become a senior member!? He bought the property for $357,000 2 years ago. He has been trying to sell it since February this year (for $495,000). He bought and his first attempt at selling was through our rental agents. They had several people through (all individual private inspections, no open houses) for quite some time and he apparently had an offer of $485,000 but he refused.
After several months, he considered the agents weren’t doing enough so took it off the market, got it valued by Ray White and then hired them to sell it (with a price drop of $475,000). It’s now been on the market through Ray White for a month and they have had a grand total of 12 people through the entire time, and only 2 have been actually mildly interested. 1 came through a private inspection and was interested, and out of the 10 people who’ve come in from all the open houses (every weekend, both days, grr) only 1 has had any interest whatsoever. All the others have just wandered in off the street. We assumed the vendor wasn’t too keen to spend any money to sell it (ads, etc). He hasn’t spent any money on the actual property (and it does need things done), and yet puts the rent up $20-$40 a week every single time the lease expires and is renewed (every 6 months. He won’t give a 12 month lease. We’ve been here 5 years but he wants to be able to put the rent up more regularly). Anyway, so now he’s dropped it again to $459,000. We think this is a joke considering he probably could’ve sold it back in March/April for $485,000! How the hell did I become a senior member!? I know nothing! We asked them last weekend (when they technically shouldn't have come in at the time they did anyway) to let us know as early as possible (Wednesday/Thursday) what time the next open house (for this weekend) would be, as it's a public holiday here today (Friday) and we need to make appointments on Wednesday and Thursday for the weekend with tradesmen and such. At that point they weren't sure there even would BE an open house as they were speaking to the owner during the week. The agent said he'd let us know. We heard nothing. On Thursday night when we got home we saw the disc on the For Sale sign out the front had 10-10.30am on it for Sat & Sun. We were like, oh. Ok then. Thanks for letting us know!!!!! Today is Friday. There has been no Form 9, which they are legally required to issue to us with a MINIMUM of 24 hours notice, before they can enter for the open house or to show people the premises. So...in my opinion, they chose not to give us the required Form 9, so they also have chosen not to have the open house. We tried to call them but they (both agents in charge of the open houses) didn't answer their phones (we left a msg on both), and the office girl was very unhelpful and said she couldn't do anything.
