I use the HIA standard contract. How about you? Thanks I did not add anything special to my contract, the inspector previously advised part 2 section 19 of the Domestic Building Contracts Act 1995. Quoting the act, http://www.legislation.vic.gov.au/domin ... 91a061.pdf : " 19. Access to building site (1) A builder must permit the building owner (or a person authorised by the building owner) to have reasonable access to the building site and to view any part of the building works. Penalty: 20 penalty units. (2) A person who is exercising a right of access granted under sub-section (1) must not interfere with the carrying out of the building works. (3) A builder is not liable for any costs or delays— (a) that result from any failure by a person to comply with sub-section (2); and (b) that the builder notifies the building owner of in writing within 5 business days of the failure to comply occurring. " From what I understand its a standard requirement to be able to do independent inspections, but perhaps query your inspector once you choose one? Before you sign the contract ? How this clause should be worded? I'm not a lawyer, so I cannot help Maybe double-check with the independent inspector you intend to use and see if they can help? Although if your working with contract and want to add a legal clause in, the only person qualified to do this is a lawyer. I believe in my contract only the *final* payment may be withheld for fixing defects, no others. I haven't had any issues so far with getting defects fixed though Re: Bafto Homes Custom Build - Tiles arrived 93Sep 06, 2012 9:41 pm The builder has clarified that the various "defects" I've found is mostly unfinished work. The marks in the garage are where something was moved from to make it look more neat. The external paint needs another coat. The lock that has rusted was most likely effected by the acid washing and will need replacement. Things are progressing slowly, hopefully finished in the next two to three weeks. Ideally you should get someone with a legal background to read through your contract, I read through my own and questioned the parts I did not understand. The builder explained why they were there, in my opinion the legal advice would get very expensive, although if you do sign a contract with something incorrect in there it could be costly. The price is fixed throughout the construction period, I have had no variations in price, Bafto went out of the way to *absorb* changes in the price. I did create many variations which obviously cost money, but that was changes to the plan I believe there is some kind of inspection of the various stages. An indepdendent inspector is an inspector who works for you and sends you a report of defects they found. I'd strongly recommend having one, although they are expensive. There is one building inspector which posts on these forums and you can see examples of things they find during the builds they inspect. I planned to have 3 stages of inspection at $500/stage. But ended up with 2. There is still a few things to be done, I do suspect they will only do some things after the list of defects will come from the handover inspection, but I will find out soon.
