Browse Forums Building A New House Re: Exclusive possession - HIA contract 2Aug 19, 2012 9:24 pm This has already been explained correctly in your other thread asking for clarification on the HIA contract. If you're looking for sound legal advice regarding the best course of action to resolve the situation you are currently in then you will eventually have to go to a solicitor/lawyer - you are unfortunately not going to get it here on the H1 forums as nobody here is aware of the full circumstances and the course of events surrounding your current predicament. I fully understand the cost issue involved with getting professional legal advice - there may be an alternative to getting lawyers involved though. I would start with contacting BACV (Building Advice and Conciliation Victoria) first and explaning your situation to them - it's an arm of the Building Commission of Victoria which provides free advice and in some cases a low-cost path for conciliation in disputes between builders and clients. You can find their contact details here: http://www.buildingcommission.com.au/www/html/1196-building-advice--conciliation-victoria.asp The BACV (and the Building Commission in general) can be seen to be a bit of a toothless tiger depending on whose opinion you listen to but at least it's a start. At best they might be able to help facilitate conciliation between the two parties. At worst they'll inform you there is not much they can do and that you will have to take the issue further (eg. VCAT or Consumer Affairs), but at least you'll know that's the path you need to follow to resolve the issue. Some people apparently have nothing better to do than comment on other people's sigs. Re: Exclusive possession - HIA contract 3Aug 25, 2012 9:05 am the simple answer, better one maybe already, is the builder does works, no-one else, and you cannot do works or alter his works, not without his ok. you can look at the works, as you still own the land and as the owner you are entitled to go to your property. leighton at clark new homes Re: Exclusive possession - HIA contract 4Aug 25, 2012 10:49 am There is more to it than this - it's a bit of a messy issue the OP has run into as explained in his previous thread. Some people apparently have nothing better to do than comment on other people's sigs. You talk about deletions, are they variations or PS and PC adjustments? pleas list them 1 16555 10 12303 Unless there is something in special conditions the builder does not have to give you timeline.
