Cheers. Helen After fighting for almost 2 years now I'm not sure there is any fight left in me. Between Developer delays, site start penalties, house and land packages that are not really house and land packages, bank errors, contract price errors, legal contracts that state if you have the legal contract looked over by solicitors they will be voided (i.e. legal contracts that you cannot seek legal advice on), contract blow outs, incorrect building plans, bad tradesmen who don't seem to care and don't come back to fix mistakes (the main excuse as to why my build went well over), inadequate penalties that don't seem to get paid anyway... yep, I think I'm just about done fighting, complaining, contacting or calling anyone anymore. I have tried to avoid getting legal advice on this for a long time, in fact, all during my build, when after paying good money for independent inspections at frame, fixing, and final stage and knowing nothing was being done about these issues brought up in reports(that were paid for by me) sent to my SS and BC I know that whatever I do makes little difference. I'm all out of "catching more flies with honey" as the honey approach does not seem to make any difference. Even with all the face punching I got during my build, I was still always nice, polite, and understanding to all the PD staff that I spoke to. Now that I finally have a phone you could call me (yes, up until last week my phone line was not working so after spending 3 weeks, time off work, and more than 10 hours (not an exaggeration either, I have the logs) on the phone between telstra and the PD wiring contractors they found that the phone line was not connected to the splitter inside the house correctly. From telstra's end, everything was connected correctly and I will still have to pay 3 weeks of phone line rental even though I couldn't use a phone.) As I said, I was willing to take the piddly penalty cheque and move on but as even this small thing seems to elude me, I think I will be forced to find a professional that can get this last thing done for me. The penalty cheque was supposed to be ready on handover. Not only was it not ready, there was no one in the office on the handover day to sign it off anyway. I was told all staff that could possibly sign it off were "in a meeting". I had to settle with leaving the head office with only the wrong set of keys (yes... the keys to the back bi-fold door were the wrong keys and didn't open the door). As far as I can gather, PD have forced me to look at this as the only option now. ******** pp: I called the PD office as recently as this morning to enquire about my penalty cheque and where it was. I have still not received a call back yet. Only after speaking with a colleague about my frustrations (he has heard them all since I started the building process) and his advice that I seek a professional to continue the fight have I come to this think that this might be my only means of getting this issue closed. 1. We asked for a single pane fixed window, paid for it but they have fixed a split pane fixed window, spoke to the BC after sending number of emails to the SS. The SS only say we will fix everything prior to handover (have been hearing this line all the time from day one) 2. I have also noticed that someone at PD has decided to choose our ensuite basins and no one has informed us of this change. 3. Many electrical points missing...do we get a credit for this or should we get them to put the points. 4. Water gets logged on besides our slab, sent photo's to the SS said he would fix the drains, I don't think this has been fixed as yet as water is still getting logged...This I believe is serious as I learned that this can cause the slab to heave. 5. Wrong heating unit (SS said he will ensure we get the upgraded model we paid for) 6. Cracks on bricks. 7. Garage and laundry doors painted wrong colour. 8. Floor tiles look different from the sample we bought...were offered the "different batch excuse" There are many more issues...has anyone else encountered similar issues (Zinner your issues are far bigger than ours). When we first selected PD we expected nothing less than quality but its far from what we are getting. I am only hoping at handover they walk the talk. Three options 1 Ask the liquidator 2 Find another PD customer and ask the source of their report 3 Pay for new report 3 12322 Ask for references and speak to them.
