Quick summary Still no PCI date. Still no approximate completion date. Unable to cover the rent + interest on the build which means we will be effectively homeless at the end of the month. Liquidated damages are only paid on completion of the build and then it is only at what I found was the absolute minimum of $250 a week so this wont help us in the short term. We were told by the BC that our PCI would be this week but found out from the SS that there was no chance of that. He was also unable to give me a new PCI date or approximate completion date. I found out that the contract could effectively last until September at the earliest before we could get out of it. Being that we have never built before and that we were unable to have the contract reviewed before signing (alarm bells were ringing!), we signed a contract that contains the standard minimum $250 liquidated damages. We knew that this wouldn't cover rent but being new to building, and not being able to have the contract reviewed, we didn't know we had any choice in changing this. I have since found out that many people make sure this clause is changed to reflect the actual damages suffered (i.e. rent + interest) and not this farcicle amount. This amount is obviously not enough to inspire the builder to finish our build on time. I get the feeling we are the laughing stock at head office ("look, another minimum liq dam sign up... lolz...") DW was in tears on the weekend wondering how and why this had happened to us and how it is that we are going to be homeless considering that we have always paid on time and there has been nothing adverse in the building process (i.e. no floods, fire, major issues). We hear all the "dont worry, you will be fine when you finally move into your new house" etc... but there is nothing a new house (or anything else) could do to compensate for being made homeless. How can Porter Davis let your build drag out like this? To watch other people in the estate move into their homes that started after you must be soo disappointing for your family, I mean I know every build is different and has their problems that can delay a build but this is ridiculous. Is there family or friends that can take you in as surely it can't be too many more weeks to go? My thoughts are with you guys. I think technically they are supposed to pay $250 per week to you although most builders deduct the amount from the final invoice. It may be worth contacting Building Advice and Conciliation Victoria to see what they say. Good luck and I hope it all works out for you. Not really concerned with how the house is going anymore. I have bigger concerns now. Still no PCI or completion date. 42 weeks on its been way to many times of getting my hopes up about an approximate completion date and having them smashed for me to care anymore. Currently in talks with the bank and real estate to avoid being homeless and organising places for the wife and kids to stay if I cannot sort it out in time (as we wont be able to all stay together atm). After reading your last post, I feel near to tears and just wanted to say I'm so so sorry for the unprofessional way you have been treated by PD during your build. I hope you can sort out your living arrangements to stay together during this final stage. I wish there were something I could do for you! I hope you are able to arrange something so you and your family can stay together during the last stage of the builder. Like you I signed the $250 liquated damages agreement not knowing i could increase the dollar amount to actually cover living expenses. Thankfully we were staying with my folks and we didnt have to claim this but $250 is an absolute joke. Hang in there and hopefully you will be in your home soon. The bank have also generously decided to loan us the money (@ 22% + insurance costs every month) to pay for the shortfall between our rent and our penalties ( we wont get paid penalties until the house is finished anyway so we are effectively paying 22% on the whole rent). Its nice to see just how many people there are to... "help"... when your in a sticky situation... ( Bank can see more $$ from us a mile away...). We still have no PCI and no completion date on the house. Just like we have done for the past 18 or so weeks... we hope we might get some sort of commitment to a PCI next week... With the rain predicted I'm not betting on it... I tried contacting the our new BC but the phone just rings out. As there is no PCI date anyway, I'm not to fussed as I don't really have anything to say until we get a PCI date. I just thought it would be nice to talk to our new BC and officially start the communication with her as she has not bothered to contact us yet. I got the feeling that we have been totally forgotten by the PD staff anyway and whats the bet that at our handover (if that day ever comes), our paper work is all messed up or lost. Are you able to ring the project manager (your SS boss ) about all this, we did this and it was to our benefit.
