The neighbours prior to any work beginning on my block brought in a heap of dirt & built up their land along the boundary & tapered the dirt onto my block. Subsequently we need a retaining wall. I have spoken to the neighbours who believe they are only 20% responsible for the retaining wall. I have been to council & master builders & showed them photos & they have all said the other people are responsible. We just cant get them to accept that. Is there some kind of report I can get that shows exactly who is responsible for what %. The council has said they dont get involved in this kind of disagreement Re: Retaining wall - who pays 2Jan 02, 2012 8:34 pm In this case you are responsible for the cut and them for the fill. Work out what % below the natural ground level your cut will be and what % they have filled. If they don't want to come to the party, if possible you can cut 500mm in from the boundary and retain this. Once the fence goes up they will have no option but to retain there fill. And don't be worried how it turns out, by the sounds of there attitude there going to be pain in the a*^e neighbours. I'm surprised the Council did not support you on this matter. Perhaps a visit to Council in person will get you a chat with someone other than the person at the front counter. Think about it. The neighbour has illegally dumped soil on your property. This would probably involved a fine. The Council should get involved.
