We have cabling through DAH and junction boxes that we have already paid for. What do you think? Also, met with a landscape designer today - who I just love love love!!! Well I guess I should wait for the quote before I fall in love!!! Anyway, he has come up with some great ideas - we 'may' be having a herb garden, a vegetable garden and fruit trees/plants - so a real organic, simple garden that provides us with food - yum yum! I am waiting for quote, but he was great. Yesterday I was lost and now we have a theme for the garden! Our garden is going to have things in we can use for cooking!!! So so excited - lets hope its cheap! He is also quoting us for paving around pool and down side of house, for installing semi-frameless glass fencing, gates to side of house and front garden with postbox! Our neighbours houses to the right, left and back have all been there in excess of three and a half years! So, when we bought the land we went to see it and the lady neighbour to the right came out and said 'you do know you owe us for the fences don't you?'!!! Nice greeting from a new nieghbour don't ya think !!!??? My question, should the owner of the land have paid for the fences? It is a private sale and the fences have been there for over 3 years and he has owned the land this long too? Should they have approached him or do we have to pay for the fences the neighbour has chosen? If we have to pay, do they need to show us the invoice they paid? At the end of the day, both us and the previous owners could have paid as I have no idea if they paid or not??? I know the payment would have to be at todays prices too... Does anyone know how long we have to pay this also? We want to finish building the house and get moved in before we even think about an extra bill and they havn't asked again since??? If it is our responsibility to pay we obviously will but just wondered if anyone on here knows a bit more? If they are going to get you to pay for the fence, they need to notify you in writing before they build them. Look at the council website. If the land was vacant when you purchased it then the previous owner didn't have to pay up and also because it was vacant your neighbours didn't have to ask about putting the fences up. I think you'll find you've got to pay but they will have to provide evidence of what they actually paid and it can't be a quote for what it would cost now. It turns out that the land selling company paid for it. They paid for fence to rear and to right and gave me the lot numbers so the owners never paid for it. It was part of all land packages that the land selling company would pay to standardize the look of the street. If people wanted to choose their own fencing they obviously could at their own expense. I phoned the land selling company to see if they wanted the money and they said no they don't. They advised that they have the receipt for the purchase not the owners as the owners were never asked to pay. Ofvthe owners have replaced the fence then they need to prove tobus that this was necessary. They have said they will support us against the claim should it go ahead. I font want to upset neighbours do I will just be positive and ask them to provide me with the receipt. They havnt got this obviously so we will see what happens from there. They can take us to small claims apparently but only if they paid for it and the company assure me they havnt! I font k ow what to think! I think they are a little cheeky, but who knows they may still be entitled! Shame factor on them is high though!!! I couldn't charge for something I hadnt paid for. We checked the fence thing out thoroughly before putting it up. We are in a semi-established street in an established area (ie, not in a development estate, as such. Private onsell rather than through developers 'package'). North neighbour hasn't touched his land yet, nor has anything been submitted to council, so we can't ask him for money for our shared fence yet. South neighbour was about 6 weeks behind us, so we shared the cost and that one is all good. We do suspect that north neighbour may sell his block rather than build, but being in real estate, we will be keeping an eye out and approaching the agent who lists it to alert them to the fact that we are owed money for the fence. If the seller isn't prepared to add that as a condition of the sale, then we'll look into putting a caveat on the property so that someone has to pay us. If your land developers included the neighbourhood fences in their package, then your neighbour has no right whatsoever to claim anything from you!
