As Lizzie says your colour selections are not finalised until you sign all of the contract documentation although I would pursue them to ensure this is rectified as soon as possible. Just phone and email continously until you get a satisfactory response. There were some issues that I wanted to vary following our contract documents being sent to us but the builder would only make those variations if we paid the variation fee ($1000 or $1500 from memory). Needless to say we didn't bother. One thing that I failed to add the other day was that I believe the progress payment schedule is completely unfair. For example, as at 30 November 2010 we had made payment of 95% of our contract price. There is merely the balance of 5% to be claimed yet the builder still can't give a handover date. When I raised the issue of delay with the builder the response was that they are running ahead of time and that our contract doesn't require completion of the house until March 2010 - on that reasoning we should have only paid about 50% of the price by 30 November (being about half way through the projected time). While I appreciate that the progress payments are staged based given the cost of 2 properties (mortgage repayments etc) one would hope for a more cooperative approach to see us in our house sooner rather than later. We paid initial deposit mid November 2010 and are still going through interim consolidated tender stage. Not signed on it as still incorrect. MJD have told me (in not exactly thoise words) that I'm holding things up and should sign it as soon as possible??? Needless to say, I'm furious and have expressed this to them accordingly. Could anyone tell me if this is the same for them...after deposit in display office our 'case' was handed to a person in the head office. Has anyone had success changing their sals consultant to someone else? If so, who did you escalate this too. Bon, I'm curious who was your useless consultant, maybe we have the same one.
