Afterall, it is your neighbour who you will be living next to for most probably years. If they were intending on making this into a feature wall, sounds like they have felt their privacy has been violated. (never underestimate noise pollution or lack of privacy - real issues) It's not too late to negotiate and consult with each other (both sides have to try to be level headed and not let emotions get in the way) I wish you all the very best and keep us posted Re: Neighbour angry after we removed some retaining wall 22Aug 14, 2010 6:14 pm I am pleased that you managed to come to a compromise. I must admit that I would be a bit annoyed if a neighbour removed a bit of the retaining wall without consulting us first. It was interesting to read the article about the boundary. We recently discovered that there is a small issue with our fenceline. We are building on land that has been in a residental area for a while and our fenceline is crooked...but not by a lot. You can't tell by looking at it but we made the discovery when we sorted out the slab for our shed. I think we have about 10 cm too much at the front and but then we lose nearly the same amount at the back. We've not sure what we'll do about it yet- but will definitely be contacting the neighbours to get their opinion before we do anything. Us saying "it's on our property we can do what we like" or "it's not retaining anything so what's the point". Them saying "it's a dividing wall/fence and us not legally allowed to move it". Anyway we came up with a compromise where we will put back a section of the wall and leave a section that is blocking our side pathway. http://1.bp.blogspot.com/_9PGfitpCHgA/TGY4kEbEFiI/AAAAAAAAAUg/_AI3lvbmAO8/s1600/P1000032_resize.JPG Just make sure its safe these boulder/stones can be quite dangerous just sitting on top of each other and if it is on you property you don't want to be liable for any damage done to person or property, put it back on the nieghbours and ask if they want to be liable for any damage these stones may cause if they fall that can quite often change there minds. Also if this wall was in you property it is not a dividing wall/fence that would only count if it was of the boundry. I'm going through similar issues with a neighbour and we didn't talk to them about our plans so they complained to the council. We've proven that the wall is on our block. I'm so sick of having to care about how it effects someone else if it's your property (yes, I know I will cause offence at that but that is my opion). Until it impacts on you and your right to enjoy your land / house though right? That's what I was thinking. What if your neighbour put up a 15ft flourescent pink screen? Sometimes what seems reasonable to one person is not to another. Happy to hear you have a resolution micks_k. If the wall is on a boundry it is up to both neighbours to negotiate where the wall/fence ******, whether on the filled side of the boundry,50/50 on the boundry line or on the neighbours side of the boundry (unfilled-cut land). If it`s on your side then you can pretty much do what you like. Though a bit of ground work/courtesy with your neighbour doesn`t hurt and would smooth things over. Thank you again Simeon..
