7 months ago when we bought our block of land, all the blocks had been cleared of shrubbery and the only trees on them were the ones that needed to stay due to the vegetation protection overlay. All the roads had been done, street lights were up. In essence, apart from having titles, the whole estate was a finished development. Since then the developers have done nothing with the estate that I can see and as a result our block and many others around ours have lots of re-growth. I don't know exactly what the trees are, gums of some description I suppose.
My question is, do the developers need to re-clear our land before it settles? The way I see it is that they need to hand it over to us in the same condition it was when we agreed to buy the block. Is this correct? I'm in Central Vic, and I imagine VCAT or Consumer Affairs would be the authority on matters such as these.
Just for some additional information, just a couple of weeks ago we requested compensation for various reasons relating to the delay in titles, and they granted us a substantial amount to be paid to us at land settlement. Can they claim that since they have given us this extra money that they are not accountable for the excess shrubbery on the block?
