We are taking ours when the date the contract was signed
the builder takes it from the day the last building permit was obtained.(july) the pad went down soon after.
We entered into all of this with them in january (when we paid our $1000 deposit)
So i dont know when you would take it from really.

The power was reconnected yesterday the 16th. The ceiling painting will be finished today and the walls patched ready for painting. Monday the wood floors go in and tuesday the carpets if all goes to plan. not sure where we are with the rest of the 'hit list"
Handover meeting is supposed to be Wednesday the 20th. We shall see what happens then and if all faults are rectified.

Okay. the "hit list: meeting is a joke as nothing on the list has been done except for the power.. The PCI meeting is supposed to be Wednesday but it seems that we are supposed to get the work on the list done during the :maintenance period. So all the holes in the mortar, and a list of other things is not getting done before we move in. This house has not even had a final clean or the flyscreens put on. Totally confused and not happy and they want the final payment. Any one have any ideas on what is going on here. they also want us to sign a varience on the bay window and have had another set of final drawings made up to change the size and shape of the window.
It just keeps getting worse instead of better.

Did you end up getting an inspector out o look at it? I know there's some clause dealing with practical completion that means you can't hold off on paying them. Like if the house is habitable and the things that need fixing don't affect you living there then it's considered to be complete.
After all you've been through though I'd say that they owe you a bit to have you happy. We're in a similar boat but our builder has recognised that we've been through the shi%%er to get where we are so is doing the right thing to get us happy. We once looked at it but it sounds like you've got some valid reasons to get in touch with MBA and seek some advise. The phone hotline is expensive so make sure you have your queries marked out and talk fast but contacting them and an inspector is the course i'd be taking.

Well not exactly. Technically they are still bound by a contract and have to correct maintenance issues in the contracted number of days. If this doesn't happen then the owner can take action! Usually the suggestion of getting legal action is enough to spark work to be done in this situation. When works happening you still need to be vigilant with inspecting it yourself to ensure workmanship you're happy with. After all it has to be correct and meet a standard for the work.
If you refuse payment after "practical completion" is met or agreed (remembering after the PCI the builder has 10 working days to correct any issues before the official handover occurs) you can be slapped not only with interest calculated on the payments lateness but you also run the risk of the builder enforcing a price rise on the house.
This is my understanding anyway maybe some more educated or experienced people on this can elaborate a little.

Technically, you are right, however experiences of other board members shows it is hard enough to get things done when you have not yet settled. As for the legal action, there are a few postings on this board that would be worth a read.

Hi Adrian and bunoluva. An update for you on things as they stand at the moment.
The PCI (practical completion inspection) has been cancelled until after the new year and we have a meeting to discuss compensation with them tomorrow.
The BRB will get involved up to three years after the completion for faulty workmanship but only if it is under a cerain amount for the cost of the house to be built under contract. i think it is under $200.000 over that amount you have to go to someone else. Ours is under that amount. Summit have by now realised that we are not going to be pushed into releasing the final payment until we are happy.and all the faults are rectified before we move in and not in the 3 months maintenance period. We all know how hard it is too get a tradie out to a house to fix something after you have moved in so no doubt the 3 months would be wittled away and we would end up paying for it too be fixed ourselves. plus we both work and I am sure they would not reimburse us to take time off work to be there to let tradies in to rectify faults so we would be out of pocket in lost wages too.( thats if they turn up when they say they will of course)
Until this meeting tomorrow we have no idea which way they are going to go next. It just seems they are trying differant ways to get out of doing the right thing by us.

We have had a compensation meeting with Summit and an amount has been agreed on.
We have another date for the PCI on the 9th of Jan.
nothing has been done to the house in this time except our carpets and wood floors were installed the carpet people did a very nice Job.
Our site supervisor has quit and we dont know if he is finishing our house or if we are getting another one. We actually wish him well as he had a difficult job with these houses to bring them all up to date.
So now we wait until the New Year to see what drama happens next.

Hi all. here we go again. Still have not had the PCI. have not recieved the compensation check and absolutely nothing has been done to the house in All this time. Yep we are been conned once again. So here we go again with Phone calls to get this house finished. They have done nothing on the "HIT LIST" and we are still waiting for every thing to be finished off.

Had PCI yesterday the !!th. Now we do all the nitty gritty final things our end and hope they do the the things they are supposed to do to finish the house off. Ten days to go and hopefully all of this will be over.

Hello Healeycole,I stumbled across this site while searching for sites involved in Home building,building products,building design etc.I do this a couple of times a week after work for a few hours as home building is a big part of my life and I find the internet a good way to keep up with design trends,where the work is etc.When I read your story I was shocked to hear how this company treated you.I live and work in a town roughly the same size as Bunbury (Wagga Wagga NSW)and if I treated a customer as you've been treated I would have been run out of town years ago.You must have a different grapevine system there as most people in the industry around here know each other at least by name if not personally and this is a town of approximately 60,000.As far as supervisors go I reckon you'd get a decent one about once in ten in my experience.I know lack of tradesmen can affect the industry greatly ,especially in regional areas but the end result should never be to lie to people and hope they will "cop"whatever is dished out (that is as well as the terrible tradework of course) You have been treated badly by this mob and I hope you can go the distance now and get a decent result with your house.If you went to Fair trading to check on myself or my brother http://austwidehomes.com.au/ (who I work for) you won't find a blemish on our licences or our son's either,and we have been building here in Wagga Wagga and district for approx 30 years so it isn't impossible to keep people happy over a long period.Anyway Healeycole,in summing up I hope you don't think all tradesmen are like the ones that you encountered as I'm almost embarrassed to admit that I am one after reading your story.As for signing the contract on the 1st of April you'd have to wonder about that as it's turned out.I hope things get better next time you build as it's supposed to be an exciting process for you. One thing we've noticed (we're building with a different company here in Bunbury...not sure if we're both trying to build in the same area though) is we have had to ask nearly every trade that has been through to come back and fix or correct something that isn't to standard. Alot of it is simple lazziness on the part of the trades but it is concerning that with some supervisors these problems aren't often chased up until we question it. We wonder if alot of the faults would have been left the way they were if we hadn't highlighted them.

Hi Terry1 and bunnoluva. Have been flat out as you can imagine getting every thing organised. this is the last tme for a long time (I HOPE) that we will have to do a move. Have arranged to have a few days off work to get it all finished as it is too hard to do and work full time as well so hopefully I will be able to post more in the next few days.
things have still not been finished by Summit but it is only small stuff so not too bothered if it gets done after the BIG move. Will post more later today

OK. For better or worse the final payment has been organised.The fly screens are on and the sand around the house compacted ready for concreting. All the curtains are made and up at the windows. Significant other half painted all the walls with windows so the pelmets and curtains could go up and we dont have to take them down to paint and has also first coated the other walls and feature walls. It is finally starting to look like a home instead of a house. Still dont have the excitement of moving in yet though I was hoping to have a spark of something by now. Maybe when I actually put the furniture in it will happen. Even if it is just pride in doing the decorating and putting the icing on the house. I dunno.... Still nothing from Summit on the last few things they have to do although the other half has seen them at work and they say it will be done for us and the compensation cheque will be posted after the final payment has been received..
I will take some photos of the finished product soon and post them as it is amazing the difference a coat of paint, carpets and timber flooring and curtains make to a house.

Sounds like after a long battle you have agreed some compensation. Do you feel in the end that with this compensation all has been put to rest with Summit? Or would you still hold the same views about not recommending them?

Hi Best Builder. The compensation is for money, time (and stress) that we have lost so the answer to your question would have to be a resounding no. We would not recommend this builder to anyone under any circumstances. We are still not really satisfied with the end result and only one item out of twelve on the PCI list in 10 working days has been completed.
Still not a good effort on there behalf but expected.

Does any thing ever go right for us.
We authorised the final payment and the valuer went to the wrong house. They went to a house down the road and knocked on the door and no one was home so they just put in the report that it looked like we had rented the premises out
Well that and the public holiday has delayed us once again.

Rather than make the final payment and then wait for the agreed cmpensaton cheque, would it not have been safer/better to only pay the difference?
