Rock provision credit

Hi all,

Was just wondering how many of you at the end of your build your rock provision covered the cost and therefore received a credit for the difference?

My provision was around $7k (35 cubic metres), but I have seen the rock removed and have photographed the rock removed and it looks only 4 cubic metres. Therefore I expect a $6k refund.

My solicitor has told me that as stated in the HIA contract the builder has to provide invoices which they received for rock removal as evidence of their charging onto myself.

Did you all receive this evidence or just accept the rock removal costs? Is it likely for a large company like H3nley to 'boost' what they charge clients for rock removal ?

If I receive anything less than an unsustantiated $6k, I will have to pass it onto my property solicitor.

Yes they HAVE to show you evidence. But they are also entitled under the HIA contract to charge you 25% builders markup on top of that cost. ie. If the builder was charged $1000 for rock removal they will charge you $1250.

What do you think the chances are of a large company like H3nely trying to make up costs and therefore charge extra for non-existent rock?

My parents are about to pay a deposit on a build and are keen to see if H play any games, and may go with PD instead. So far though H3nley have been pretty good. The home presentation will tell all.

Hi TCloth,

Our rock provision with H3nl3y was around 5K and they removed absolutely ZERO rock from our lot, so we are anticipating a full refund of the rock provision at the end of the build (as I understand it, you don't get the refund for site work until the build is complete). We are due to inquire about that soon as we have just completed lock up stage, but will certainly keep you posted. Happy so far with H3nl3y and their responses to our concerns.

Good question, I'll let you know in 7 to 8 months. Mine was only $2500. If I got that back it would mean a new lounge suite...

My advice and what I intend to do, would be to talk to your site supervisor, bring it up in casual conversation and let them know that your are keeping an eye on proceedings and how much rock you have seen removed. It would make it hard for them to come up with a generic figure instead of an accurate figure.

Oh yeah... you can't forget about the 25% mark-up. My solar hot-water and water tank system is testament to that.

hi guys,

surprisingly we had quite a few rocks dug out from our land, and guess what we received most of our money back!!! there was only i think about $2500 allowed but most of it was credited back .... this is so far the only good thing our builder has done for us!!!

our rock allowance was credited back to us - the credit was shown on the final invoice.
