Welcome to the forum too! Thanks Matt........ Great site, I have been recommending it to all my friends. (Qty .3 regards Bernard Re: P@rter D@vis Final Contract meeting 6Nov 17, 2007 8:16 pm At our contract meeting with PD we went through the whole contract (about 4 hours). It was long and boring and I was sick and tired of it by the end and wasn't paying as much attention at the end because I'd had enough.
If I were you I'd try go through the contract with them but take it away with you and sign on another day IF they allow this. We didn't so I'm not sure if it can be done that way. If not, get copies of all changes made on the day. No doubt there will be mistakes in the contracts AND the drawings. Make changes at the meeting but make sure you get photocopies of the changes that are made on the day, firstly so you have a record for your own benefit and secondly so you have a record if they neglect to make the changes properly. Don't rely too much on the knowledge of the Customer Service person because they don't have a lot - do your own homework. I hope this doesn't sound too negative. We had a pretty good experience with PD but most of our annoyances arose from mistakes in the tender, contract and drawings that had to be changed sometimes more than once. For example, we opted for a tiled splashback in lieue of glass. They kept on putting the glass one in the documents - I think we told them 400 hundred times. The trouble is that once a mistake is in writing, they would rather believe the writing than you! Re: P@rter D@vis Final Contract meeting 7Nov 17, 2007 8:44 pm And one more thing. If you've asked any questions and been given any assurances, make sure they are in the contract. Only what's in the contract counts; anything else didn't happpen. The verbal statements only mean something if you can find the air the were written on. Hopefully for you PD will be the same. At our tender meeting, Clarendon gave us a sample contract to give us an idea of what to expect. We were also given the opportunity to take the contract away before signing. We're building with PD and we went through the entire contract on the day too - line for line and it took 6 hours. We had made a couple of changes to the electrical plan a few days before the contract signing and they hadn't been reflected because the electrical people hadn't send the update through on time so they were added to the post contract variation document ...even though they weren't post contract varations. Anyway. We could have taken a copy and gone through and signed another day but decided to just knock it on the head. The post contract variation document was sent to us a couple of days later and we had 7 days to make any updates (free of charge). All the changes were reflected, we signed that and now we're on our way. Next step is final drawings. Re: P@rter D@vis Final Contract meeting 11Nov 18, 2007 7:15 pm When we did our Tender appointment a copy of the contract was given to us then - meaning we had weeks to look over it. At contract time we concentrated on the additions, exclusions and changes.
Having said that, we are off to another contract appointment soon! Cheers Perry Re: P@rter D@vis Final Contract meeting 12Nov 18, 2007 9:21 pm They have you read it there and then ... and it has to be signed on that day, you cant take it away. You are given a copy though.
However I seem to remember there is a cooling off period in which you may cancel it (and/or possibly make changes? - correct me if i'm wrong) .... PD use the 'Plain English Contract for New Homes' which is a standard document from HIA. You can download a copy from www.hia.com.au. You will also be required to sign a PD internal contract which lists the specifications of your house. The HIA is just a "We agree to build, this is how you pay, this is the insurance details, we are a registered builder" kinda stuff. Re: P@rter D@vis Final Contract meeting 13Nov 19, 2007 6:17 pm Well,
Got my response back from PD.... No We can not take the contract aware from the meeting..... They pointed out the following.. 1. 10 day cooling off period 2. We have look over another standard HIA contract. Can they do this? do we have any right to insist that we take it away for checking? maybe through HIA policy or something? regards Bernie Re: P@rter D@vis Final Contract meeting 15Nov 28, 2007 7:17 pm Hi All
Had final meeting, all went smoothly.... We went over all of the plans and optional extra's we wanted and everything was correct. We then proceeded to make some small changes and confirm some area's of the plans, all of our request were put in the post contract variation with estimates $$ (which we already had our own estimates for). Signed off and left happy....Two days later we have received out post contract variation in writing and all is good, prices are reasonable and are ~%99 inline with our cost estimate spreadsheet. (it was under). Overall, very happy with the process so far, just hope the building stage goes well.. All the best to everyone. best regards Bernie. Preperation of Plans Agreements 18Jan 25, 2008 8:09 am Just wondering if this sounds ******* to anyone.
One of the builders we saw would not let us take a blank copy of the preperation of plans agreement to have a look at. It really put us off. Any ideas why they would do that? I don't want to sign anything without getting someone else to look at it. Re: P@rter D@vis Final Contract meeting 19Jan 25, 2008 8:45 am You are entitled to take the contract away with you regardless of what the company says. The document is a contract and you are entitled to seek legal advice about the contents prior to signing.
The builder wants your signature now because once they have it, they know you are less likely to pull out over the 10 day cooling off period than if they don't have your signature at all. No CSR wants to have two contract meetings either. Re: P@rter D@vis Final Contract meeting 20Feb 01, 2008 1:29 pm Thanks for the advice. It didn't sound right to me!
