I think you have a better chance of being consistent with the second option....but not sure how willing the company is with parting with their money....
Funny though, your builder get's off scott free out of this, it was their tradie who laid the bricks without noticing or saying anything until it was too late.... Surely they would have seen the storm brewing in this situation!!!! I did tell them that i would only let them do the staining if they put it in writng they would treat every brick (not only the wrong ones) with their staining process. About the tradies laying the bricks, I walked around that house hundreds of times not noticing the different colors until the scaffolding had come down. If you stand really close to the wall as the brickies would have on the scaffold you couldn't notice it but i am positive you could see the difference as they were walking up to get the bricks off the pallet. Looks like they used the darker coloured bricks first on the bottom bit. Were they delivered in two seperate loads or at the same time?
