As you correctly point out the act is open as all are to interpritation, what is “reasonable”. My post was aimed at making people aware that they have legal rights. When builders put clauses in contracts and send out disclaimers to owners that contravene the DB Act, to protect themselves, that’s not fair. It’s not fair that people are lead to believe they can’t go into their own home to experience the enjoyment of their dream that they have paid for. I can’t see anything wrong with doing that. I honestly don't understand why you'd want to start a build with an "us against them" attitude towards your builder?? I was not the one who sent the letter telling me I can’t access my site, it was the builder. So I guess its “them against me” My post was asking has anyone else got one and I think the majority have said yes. I’m sorry Joles but price, flexibility, fantasy or control has nothing to do with site access as the Act applies to all Domestic Building Contracts in Victoria regardless of the price or who builds it. So too does the O, H & Safety Act. You are right I don’t want to antagonize my builder as he has a good reputation. I feel a lot of this comes from people having too much access and they are their every day telling the tradesmen and woman how to do their job. Never the less I will be discussing it with him some more. As you said most people go on site anyway after 5.00pm even after they sign a disclaimer not to. So far they've been pretty good. They even told us: "Off the record, everybody knows you're going to go for a look on site every weekend. Just don't get yourself hurt because our endurance doesn't cover you" Trying this building gig one more time. Now that's the sign of a good builder. (See the OH&S excuse does not hold water!) Or they just haven't been sued yet. I'm not saying it is correct, I'm just saying it's understandable. In a perfect world, all the builders would be like Coral. But if I ran a building company, in this day and age of people suing left, right and centre, I wouldn't run the risk. Hmm maybe but Coral is very legally concious. For example, they flat out refuse to pivot a front door since a child lost some fingers in a new house built by a different builder. You do sign an agreement for the construction key, you can use it but you don't go poking around while construction is on for safety reasons.
