HELP! 24Jun 05, 2009 3:37 pm Solicitor and i have gone over plans today over the phone..... standard eaves are 300mm.... and thats whats shown on plan and drawings. But as the contract states 450mm eaves in lieu of standard (300mm). They have to be fixed.... and quick smart! As well as being in major breach of harrisons view rules. It will be interesting.... as we have a metal frame. Solicitor has written letters, e-mail and made a few phone calls directly to the builders. So hopefully they can come up with something. Gee's talk about stressfull! I was laying in bed last night with mt head racing a million miles per hr, thinking, what if i hadn't noticed. And we took over..... how are the rules in certian areas inforced??? Would it than have become our problem. And not to mention the flack i am copping from a certian person for actually picking up on this! Apparently i should not be on site at all.... and should not see the house untill settlement! Solicitor said just to ignore it all, and i could be getting things fixed before settlement due to the fact that we are setteling house we are living in now.... and new house on the same day! So it's not unreasonable to expect the house to be done and to the standard of the contract! Gee's, yet another unload! Sorry guys! Let him fight your case (trhats what you're paying him for) at the very least you should get a nice fat credit on your final invoice cause i dont see how the builder will be able to put one eaves at this point... Hang in there...and don't stress...the house does look beautiful even without the eaves...and it would look even more beautiful when you get the credit ..... Yeah, i know thats what i said to hubby. Ha ha ha! But now i'm pretty happy that i discovered it now... and not once handover and settlement had taken place! I cannot imagine how you must be feeling with all of this. I feel personally that the issue ****** with the process you have been forced to follow by buying off the plan with the developer, rather than the builder. All the approvals have been made by them for sign off from plans to colours to everything. Whilst it can be a great way to build, there is GREAT room for error when the developer doesnt really have the desire to get it right unlike the homeowner. The sad thing is you have a great SS but you dont know that as he will deal with the developer. Stand your ground. I would feel that Delfin may try to get clever and excuse the regulations in this case as it would be in their favour to do so and they will have set the guidelines for their own estate. The other issue is, you have a steel frame build and its not just like adding a couple of nails in trusses in to wood, there are also issue about load bare and how far they need to take the join back. I hope it all gets sorted. Eaves put on before the build my backside, I dont know how you kept your cool on that one!!!!! I have a couple of questions in relation to your blog. And very blog nice indeed. 1) The display home you went to where you took the pictures of the Tuscan Red door, where was that, at Laurimar? 2) And do you know who makes Tuscan Red. We need a paint and not a stain as this is what our doors takes. We are changing our colours and this would match our garage door quite well I feel and I would like to go and see it on Sunday (tomorrow). 3) And where did you hire that cute child from.....???? Much to both our shock we found that the plans in our contract are very different to the plans that were approved by developer and council. And apparently house is being built as per their plans and approvals. So now.... We have it proven that the vendor is now in massive breach of contract. And we are well within our rights to not settle till the house is exactly as our contract plan! So now sitting back and waiting..... Our solicitor tried calling them all day yesterday to no avail. He actually spoke with the vendors solicitor on friday and let them know whats going on! But they haven't had the decency to reply - HOW RUDE! So glenn and i are going to take them for all that we can, and can hold off settlement for as long as we can till our house is as per the plans. Or unless they are willing to offer some form of compensation! We have declared war..... literally! And glenns words were last night! We are not going to be bullied. So it could be a long battle! HELP! 36Jun 10, 2009 8:41 pm Structurally..... we have 450mm eaves around the whole home (appart from garage boundary). The plans that were approved by council and defl*n do not! And also pitch of the roof is only 22 degrees, mean't to be 25 degrees as per our plans! Inside..... feature tiles in bathroom have been installed (mission brown - and disgusting), they are not in our contract! It's just so stupid of them to have the wrong plans in contract.... than to have the vendor sign every page and ackowlege every single page and still not pick it up! Idiot! He deserves everything he gets know. And hubby is getting nasty about it now! I will defiantly keep you posted! HELP! 37Jun 19, 2009 7:14 pm OK.... so now it's been a fortnight since we 1st alerted our solicitor of these problems.... Still are yet to hear anthing from the other solicitor. How bloody slack is that? So our solicitor has a plan in action.... he is adding a caviet to the property so that it can't be sold to anyone else..... as he believes that other side will just try and cancel transaction! So this way.... they can't.... and we have it as ours! As apparently their team might be just thinking if we cancel transaction they won't have any out of pocket costs, fees and so on! Also... found out the house next door (identical to ours apart from front facade and built by the same developer) sold for 30K more! So we got a mega bargain! I will keep you all updated! HELP! 38Jul 27, 2009 9:53 pm OK..... .Figured it was well overdue for an update! Well, we were mean't to have handover last monday (20th).... and we still haven't even had the C of O issued yet. And things are really getting interesting! It's now been 2 months since we allerted our solicitor of the situation.... and all has been ignored by the other side! Very, very annoying! We had our final walk though with J*King homes last thursday.... we brought up the eaves issue. And they informed us that apparently it's their standard to have eaves from the frame work..... ?????? We have never heard of this before as it's usually always from the external facade (what ever it may be, brick, timber). And had some other rather interesting things told to us that are apparently standards for this particular builder. Like silocone in the showers where the tiles meet at the corner. Bugger that for a joke. But since the final inspection (as laurimer were there with us) they have realised that the house has not even been build by the plans they approved. So no there are 3 sets of plans of our house floating around! It's driving us nutty..... and to make things even worse we are now officially homeless as of 12:30pm today! Builders have now insisted that they re do the roofing? And it could be 8-12 weeks..... Also we are now onto our 4th site forman.... they all seem to be morons! Please if you or anyone you know has bulit with Kings.... please pass on any info you can. Thanks for any info that anyone may have! HELP! 39Jul 28, 2009 10:43 am Hi Kirby My name is Helen and i'm also building in Harrison's View. My builder left out the eaves to the garage, but thank goodness they fixed them up without any major issues. I did have a panic attack when I realised they were not there though, as the developer approval was conditional to having eaves around the entire dwelling. I really do hope that everything does eventually get sorted out for you. Also I didn't realise the eaves were missing either, it was my 13 yo that noticed, I kept looking at the roof thinking something wasn't quite right but couldn't put my finger on it. Its not something that you expect to happen, but after living through the building experience and reading some of the threads on this site nothing surprises me!!!
