Does anyone know the process for an owner to cancel building application (with Brisbane City Council) on their block in case of dispute with the builder who initiated it in the past? Thanks! Not sure about Brisbane council but my council I had to cancel a older da which I had no knowledge of from the previous owners and all I had to do was write a email stating that I was the current owner and that I retract all previous development application prior to the date that I purchased the property. Tell them you're the owner now and you'd like to pull the plug on any builder's applications that are still hanging around. It's pretty straightforward, but double-checking with the council directly or on their site might give you the exact steps you need to follow. Unfortunately, it's not straightforward. BCC washed their hands off saying they can't cancel without the certifier cancelling it (as they lodged it on behalf of the builder whom we engaged & paid). Certifier gets business from the builder and didn't oblige to cancel but directed us to the builder who held us ransom until we paid them what they wanted. It was a very stressful period of our life. The system is so flawed that being the owner you don't have any right once you engage a builder even though you don't proceed to the contract with the builder. Tip to future myself.
