Re: In this forum we often rightly criticise builders.... 12Oct 25, 2023 8:11 am Quick update I have engaged the lawyer who is going to review all the documents and come up with a strategy. We have a meeting Monday. I have also notified the certifier so we will see what happens. I am hoping they can notify council and then hopefully council can give them notice to vacate. So watch this space. I will report back when I know more Simeon Architectural Homes & Duplexes - specialising in custom designing homes to your budget Get a Free Onsite Consultation Today or send a PM for information, questions or advice. Re: In this forum we often rightly criticise builders.... 13Oct 25, 2023 6:11 pm I feel for you Simeon, clients like that are pretty average.. Not to be too petty, but have you signed all the utilities over to them yet? * Ask water board to reduce water meter to minimum allowable pressure (water authority lock/mechanism)? * Not sure if electricity company can remote access the meter? * If it is technically still a construction site, maybe store a shipping container on the driveway? Ultimately, the above will just add fuel to the fire and may not help the cause. Lawyers and evidence is probably the best way to proceed.. Good luck.. I am sure you are correct, but it can't be that common right? I also contacted council today as well. Re: In this forum we often rightly criticise builders.... 17Oct 26, 2023 8:07 am If your dispute escalates it will get to the stage where there will be points of claim and points of defence. There will be an opportunity for you to include with your claim all the items not yet charged (nothing is for free) and the costs of delays caused by the owner. So maybe you will get paid for all the things you thought you did for free.(overtime, working weekends etc) Sometimes players dont know when to quit, the owner maybe should have quit while ahead. Thanks for your post. I had a feeling this might be the case so I really appreciate your advice. I will start working on a spreadsheet with all the "free work" we did. Interestingly, just had a call from council. They aren't really interested in getting involved. The best help they could give was that they won't pick up their rubbish. That would be annoying but I was hoping for more. Even if the council issued a notice requiring dwelling be vacated it could be appealed and or ignored. No magistrate will throw out and evict a family out of their own home on their land for what is a civil matter breach.
